Ltd company being dissolved but owes money - how can we get it?

This is continuation from a previous thread which has now closed, but there has been a new development which we need advice on.
A limited company owes my son over £3000 for work done, he has had a CCJ issued on them and this has now registered against the company. He was about to get the bailiffs in, although the company assets were probably negligable, when he saw the Company has applied to be dissolved. As a creditor he should been informed of this, but has not heard anything. We believe this is an offence, according to Companies house website, and is now wondering what he should do.
These are the options being considered:
1) Contact the director and say,look you have committed an offence cough up or I will report you, although previous communication attempts have been ignored.
2) Go to Companies house and report them, and see if they prosecute and get the money through them.
3)Get the bailiffs in quick to see what they can retreive.
4) Get solicitors involved to prosecute, assuming that there is a case against the company.(An outline has been sent to a solicitor but no reply received at the moment)
Although it is £3000 and not much in some peoples eyes, when you are self -employed it is a great deal!
Any advice would be very gratefully received from anyone who has experience of this.

    I would contact the court to say that the company is being dissolved and that you suspect that this is because they owe money. Also speak to Companies House and find out who the liquidators are and contact them. Companies House won't prosecute or claim money back on your behalf but they will tell you how you can possibly prevent the directors from becoming directors again especially as there is a CCJ against them (probably more than one).

    I have rung Companies house and they are dissolving the company due to non compliance, (sending in the year end accounts) This information was given freely and wiothout quetion of who I was or what interest I had in the Company, which surprised me.
    So we have to write to them and stop it happening otherwise there will be no company to try and get the money from.
    I am going to ring the court and find out local bailiffs that work for them.

    auntybee - Companies House are kind like that - you can use their website for free to find out about companies so it is not surprising that they gave you the information freely.

    Let's hope the Bailiffs can get in and sieze what they can.

  • Hi, The information that Companies House gave over the telephone is in the public domain and so there is no restriction on access. A member of the public can also view the accounts, director lists and many other documents that they hold.

    If the company has no assets, there is little point in sending in baliffs. It will just cost money.

    I think you've found out now but you need to write to companies house asking them to stop the process of dissolving the company as they owe you money. I think this gives you a 3 month hold and after that you have to renew it if you still have outstanding funds owed to you.

    LTD after a company name does not mean it is a better company, it means if they go bust you get nothing.
    Always try to limit your dealings with any LTD company to what you can afford to loose.
