Advice Please DCA and dispute

Hi,
I have an overdrawn bank account that I am disputing the charges on. I wrote to the bank at the end of March but received no reply. The next thing I knew I received a letter from Wescot credit - the bank had apparently appointed these scumbags.

I wrote to the complaints department of the bank at the beginning of the month and also sent a letter to Wescot saying that the account was in dispute and therefore they should not attempt collection.

This week I received a letter from the complaints team saying they are investigating. I also received 2 letters from Wescot, one demanding payment and saying I have failed to contact them, the second says if I don't pay in full in 14 days they will start court proceedings.

What actually makes it worse is that I have an on-hold claim for bank charges which comes to more than £1000 more than the amount they claim I owe (which in itself is almost entirely made up of charges - so if I do have to pay them will be claimed back).

What should I do now? Any suggestions very gratefully received.

    Make sure you know your rights, if a baliff comes knocking dont let him in, he cant do nothing unless he has a letter from the courts.

    Most of the time when they send letters saying they are going to start court proceedings its just bluff, to make you pay quicker.

    I think if this went to court and you told the judge that you were disputing the charges and there was no real debt, they would get a boolocking.

    I suggest you sent a snotty repsonse to complaints department and remind them that under OFT Guidlines they are responsible for the behaviur of their DCA, including copies of the two letters. Suggest that if they do not rein Wescot in you will complain to the OFT and FO.
