on what grounds do I claim my nationality?

HMRC want me to fill out a form which asks me on what basis i claim my nationality...
I claim my nationality on the basis I was born in Britain as a British citizen to British parents and have lived in Britain most of my life.
Is there some short word i can put on the form to say that?

Whenever I'm asked any 'nationality' questions I state that I am English. My parents were English. My homeland is England. My ancestors lived in England at the time of the Act of Union 1707 (that was the union between England and Scotland). So, I suppose I would put 'by residence and by descent'.

Thanks! I am not English myself (at least not wholly)- was not born there nor have i lived there...and my ancestors were pretty widely spread back in 1707...

So you could put that you are Scottish, or Welsh, or Irish 'by descent and by residence'.

What form are you completing? If a DOM 1 it will be returned unread; if a P86 you need to explain which question and page number you are referring to.
  • I have both a P85 and a P86 to fill in. It's the 2nd question on the P85. I can't find any guidance notes on the net.

(tbh I am not sure they are really applicable to my situation but as i have been sent them i better fill them in - I worked abroad for 8 months but it was only ever temporarily - I suspect i may owe a very small amount of tax to the UK - I kind of ignored doing anything about it until HMRC sent me a letter asked my about the gap in my employment-hopefully they won't fine me)

I put 'British' as that's what my passport is.

As you say the answer is not relevant so 'birth' might do - in practice you get to have to declare the non-UK earnings on your tax return, claim credit for foreign tax and maybe detached duty relief.

Thanks - I think i will just go with that...

would my overall tax liability be calculated in the same way as if i had earnt the money in the UK? or does it vary...can not find any information to explain -suppose i will find out eventually

Nationality, residence and domicile are a complicated subject.

It could be that you're UK resident but not domiciled (esp if you were not born here) in which case your foreign income could be exempt from tax if you never remitted it to the UK.

Although there are lots of rules about this. I don't know about the specific forms that you mention, have you tried a contact centre or a helpline? I suppose if you consider yourself British & the form just asks for nationality, it's as good an answer as any, but you may want to put a cover note in

I think it depends on exactly how long you were out of the country, and what country you were working in.

Thanks for the help- I know it can be a complicated subject for many people but i think you misunderstand - I am in no doubt that my nationality etc is British (and I don't have any claim to any other nationality) I just am not sure what to put as I can't exactly put 'because i always have been' and as i was on this site i thought i would ask- I'm going with 'birth'. Thanks for all your replies though.
