    You should tell the OR.

Due to the partnership agreement between the Insolvency Service and what used to be the Inland Revenue, the rebate should automatically go to the OR and you won't see it anyway. So you may have no option.

If it is paid to you, you should tell the OR within 21 days, as Section 333(2) Insolvency Act 1986 says you have to.

This may have changed since I went bankrupt a long time ago, but your tax affairs were zero'd when you went bankrupt. Its only what you have done after the bankruptcy that counts now.
If they do now give you a rebate you must give it to the OR.

  • You will have no option mate as it is classed as an asset. It will go straight to the OR

  • when you went bankrupt you should have signed a tax and national insurance disclosure authority, which includes an instruction to pay and rebate for that tax year direct to the Trustee/Official Receiver. This would have been sent to the IR. So even after discharge the IR should send directly to the Official receiver.
