Hi
Got some arrears that i have to pay back - they have stated that i have to pay them back over the next year.. i have rang today 2 c if i can pay over 2 years and they have said no.
They said that the only way to pay over longer time would be to send all housing cost details and then they would decide whether it would be over a longer time, but really it doesnt happen often.
I mentioned that i have seen that it came be paid over 2 years and she said that that is just for ppl that are going to court as they cant take then to court if they havent given them at least 2 years to pay it back
dont really want to start sending anymore details off to them that they havent already got (ie im on old csa system so they already have pay details and housing costs)
Is it right that this is the only way that i will be able to pay it over a longer time

Their steer is to recover all debt within a 2 year period - how much do you owe?0

As I understand it, it's less than 2 years if they are collecting at 5% of pay.0

just over 1k, so about £90 a month on top of the usual payment and if they are saying that i can only afford so much a week then they are nearly doubling with the arrears and this is because they cudnt decide how much the assessment was going to be and it them so long to work it out, the accounts woman said that they can take 40% of nett pay although they have housing details and can see than i would struggle to pay it0

The maximum that they can take when using a deduction of earnings order, is 40% of your net take home pay.
So if you owe arrears, and they manage to get a deo, (very easy) they will usually take 40% until the arrears are paid.
And yes it is a lot but that is just the way it is! They don't care about your housing costs.
I speak from personal experience and I do appreciate that everyones circumstances are different.0 -
Legally they can take up to 40% of your net by deducton of earnings order if you can't come to an agreement with them (that does include arrears and normal maintenance). I would be asking if they would collect over say 18 months which will lower it a bit - particularly if it was them that caused the arrears in the first place!0
