We're going to try (laughably) to recover £60 from a Debt Collection Agency on behalf of my brother.

To cut a long story short, 3 set two lots of debt collectors onto my brother for 1 account number last year, and it seems that he has paid both of the debt collection agencies £60.

Am I allowed to name them?

Agency 1 are acting on behalf of Westcot. They only quoted a Westcot reference number on correspondence which is why we didn't pick up on it.

Agency 2 seem to be acting on behalf of 3. They did quote a 3 reference number.

We rang Agency 1 and asked them to provide a 3 reference number, and when they did it matches the reference quoted by Agency 2.

3 say that Agency 2 paid the £60, which settled the bill, and they have not had any money for this account from Agency 1 or Westcot.

So, it looks like either Agency 1 or Westcot are holding onto his £60.

Agency 1 did send him a statement showing his account with them was clear so it looks like they have passed the money onto Westcot. Westcot were really nasty when we rang them and say his account has been settled in full.

Any ideas what we can do? Hope this is clear

    Of course you can name them.

    You should, also, report them to the OFT as they have clearly not ascertained the validity of the 'debt'.

    I suggest you get him to write a formal letter of complaint to Agency 1 and see what their response is. Inform them that 3 have said that they have not received the money that was due from your brother and if this is incorrect, would require copies of documents proving this. If they fail to respond to the complaint, take them to TS and OFT.

  • Okay - Agency 1 is a company called CSL (Credit Security Limited) and Agency 2 is CARS (Credit Account Recovery Solutions Ltd).

    So - thanks for the advice guys. So, I guess the first thing I can do is write to CSL and tell them 3 has no record of receiving any money from them. I guess they will say they have passed the money to Westcott?
