Can the CSA do this? Please help!

My Husbands daughter is 18 in June and is at College. She leaves College for the Summer in May and is going to work in Greece for 4 months.

The CSA have advised us that because she is planning to go back to College, we still have to pay the full amount even though she is not lving with the PWC. She will be earning £60.00 euros a day, working 6 days.

I can't understand why we should pay when his Daughter is not living with her Mum.

I believe that the PWC will still benefit from her Child Benefit, Family Tax Credits.

I know I sound a grumpy so and so, but just feel that its all for the parent with care and we just have to grin and bare it.

Any help would be great!

    I would look into this further. Surely if his daughter is going to work in Greece, then he has no liability. It may be that when she returns an begins being a student again then he is liable ... but surely her mother can't be in receipt of child benefit while she is 'working' abroad.

    The CSA have told us that he still has full liability, even though when I have called twice before we have been told that the case would be closed and when the child came back the PWC would have to reapply to the CSA.

    I don't understand how the Mother will still be getting around 400.00 a month in Working Tax Credits CSA and Child Benefit while the child will not even be living with her for that period - not sure if she will still get her EMA grant over the Summer.

    Elliejill1416 I can understand your frustration with the situation and any dealings you have had with the CSA, is it a nightmare for both sides PWC and NRPs alike.

    My understanding, is if the child is already a student, as you have stated and returning to college after the summer break, then it is classed as continuous education. Even if she was working now, he still would be liable because she is being classed as student that fits the criteria for NRP liability.

    With regards to not living with her mother grey area I think, she is intending to return back from Greece to start college, the PWC can argue that her move to Greece is only temporary or a holiday job.

    I am not sure if this effects out benefits/tax credits the PWC may be receiving because the child intends to return home to start college.

    I thought that with child tax credits/family allowance there was something about 'six weeks' in terms of having a break of living at the home? Being devil's advocate here though - the mum still needs to maintain the house, have the same bedroom etc. for the daughter to return to - and as she is a 'student', then she would be classified as a student for the whole time. I think when it comes to her working - the main thing is that she gets to keep all of her wages for use on her education, and that she is NOT paying room and board to the mum. Four months seems like a long time though to keep everything going if the child is not there.
    Do you know what the arrangement is for her accommodation/food etc. when she is in Greece? I would think if the mum is paying for any of that, then they would argue that the child support goes towards that? But....if being paid by the child herself - or by the employer, then I would like to think that makes a difference!
    Right now my ex pays child support for two children - one still at home, one away at Uni - coming home during breaks. During the breaks their dad sends c/s to me for both kids, during school time, we've agreed that the one at uni gets his sent direct to his account, as well as what I can contribute towards his keep. It just made sense - I don't have to feed him, provide transport etc., - so my costs are way down in providing for him. This way, he's an adult - he can purchase what he needs/wants with the money that would normally be sent to me.
    Hope it gets worked out for you - could you suggest that your child support be sent directly to the child whilst not living at home?

    What are you referring to exactly???

    There is no 'child' mentioned only someone who will be turning 18 in june!

    Its not illegal at all?? I worked 35 hours a week at the age of 17!!!!!
  • Thank you for everybody's responses.

    I have again spoken to the CSA and we have to continue to pay while she is working abroad. This is because she is a Student now and is planning to return back to College in September.

    They have suggested that we contact PCW and see if we can come to an arrangement with her while the daughter is working away, however we dont have or want any contact with the PWC.

    To add, the PWC is not helping her Daughter financially while she is working away - as she is terrified the CSA won't pay her.

    My Husband has paid the CSA religiously now for 5 years and I guess that we only have another year of payments to make so the end is nigh. It just seems to be such a grey area when the Child works and is in full time education. She does work 25 hours a week as well as her College Course.
