PCP Car Loans

Can anyone help please. I was mis-sold a PCP some 18 months ago. The salesman told me 'the payments are only slightly more than your current agreement'. I signed then spotted that the mileage was only 12,000miles whereas the previous was 22,000miles. he duly changed it with a pen and signed it. I thought no more of it until I got into financial difficulty and was unable to pay the loan. The garage and Financial company just say 'if the mileage had been at 22k you'd have been paying more monthly', I said 'I'd never have walked out of the showroom with a 12k agreement'. The car has now been handed back to the garage and I'm left with a very large residue (its a LandRover and no-one now wants them!) . I feel very angry that nobody will take responsibility. What do I do now?

    Simply show them your copy with his signature amending the agreement. They should pursue him and not you if he has committed a fraud by changing the paperwork.

    I can't see your point!!

    It sounds like you were paying a 12K agreement instead of the 22K agreement you expected (so you were paying less than you should have).

    But you still fell behind on payments so they took the car away leaving you with a hefty deficit.

    If you had been paying the 22K rate, surely you would have fell behind sooner leaving you with an even bigger deficit


    Or am I reading this wrong?

    Are the garage asking you to pay more because you've done 22K a year instead of 12K?

    I don't see how you were mis-sold if an alternation was made.

    Despite this, you are reponsible for the terms of the agreement. There may be an argument over the amount you owe based on 12,000 or 22,000.

    Whatever they decide you are still responsible for the debt - a mistake on the mileage will not absolve you of all responsibility.
