followed every guideline- WHAT ARE WE SUPPOSED TO DO? help?

Hi all

please somebody help - what on earth are we supposed to do - feel like we are up against brick walls.

Had lightbulb moment month ago and after seeking advice on this forum contacted CCCS, fantastic going into a DMP.

BUT ---- BIG BUTS---- we owe ONE MONTH to our mortgage - we are being charged £50 per month for every month we are still over.

However, we have now written to them TWICE, asking for - holiday payment of two months, interest only period and also asking for advice and a payment plan to help cover the arrears.

We have followed EVERY SINGLE GUIDELINE and done EVERYTHING that is written in the FSA leaflet and tonite got home to find a letter saying if we had not paid the arrears within 7 days they would put a charge on the house and contact solicitors.

WHAT MORE CAN WE DO????????? I was furious and rang them, but they were toooo busy. I tried for an hour - Letter says they are open till 8.30 pm, the telephone message says they are now closed and its only 6.30pm - how can they be allowed to get away with this??? when they want to contact you they will try all hours of day and night but you want to contact THEM and no way.

WHAT ARE YOU SUPPOSED TO DO???? - it really is big brother - they are in control and we the consumers are out of control and being controlled. Does anyone else feel like this, we need to fight, this aint right.

One month in arrrears - and we have all this!!!!!

If we had buried our heads then I would stick my hands up and say ok - I was wrong, but we have done EVERYTHING, as advised and getting nowhere.

Does anyone know our legal position because there is NO WAY after all we have tried to do to rectify the situation that 'THEY' should be allowed to 'control' us which is what it is.....

HELP, ADVISE..... PLEASE

    Good luck

    First, stay calm.

If it's a mortgage they've already got a charge on the house, so that's not much of a threat. I don't know who your lender is but I was talking to the C&G recently and they put it with their collections department after two months arrears and initiate posession proceedings at six months arrears.

CCCS should be aware of your contractual monthly instalment and that you are in arrears, and allow in your financial statement an amount to eat into the arrears. This is a priority debt, and if it's your only one I would suggest that all your 'money available' be directed to it, with token offers to the non-priorities. CCCS may have a slightly different view, but that's the principle. If you are seen to be consistently reducing your arrears no lender is going to take it to the next step.

The £50 management fee is a bit of a !!!!!!, though. Is it going on to the arrears, or the capital element of the mortgage?

Hi - we had a problem in September last year where we had gone over on a credit card and they demanded something like £500, so hubby paid them and not mortgage. Since then we have paid every month no problem but obviously have never managed to pay 'double' , thereby every month still one month behind, mortgage is £1127.

The CCCS are aware and allowed for adding £95 a month plus the £50 penalty so this has been taken into account to clear it in a year.

It is the fact that we have done everything we can to come to an arrangement and they have blatantly ignored all requests for help, advice etc.

The CCCS advised that we request a 'payment holiday' even if it was one month and we then continued to pay, the arrear would be cleared. Sounds so simple but they just didnt want to know.

I'm sorry to be be blunt BUT YOUR MORTGAGE IS THE PRIORITY not giving into someone demanding £500 from your CC company!!!!

No matter how frustrating it is all I can suggest is to try and keep phoning them.
    In debt no more!
  • HI, the cccs as you said have no interest in mortgage ,rent counil tax arrears, your unsecuired debts must wait until you have cleared arrears even if that means giving a token payment of 10p until your arrears are cleared its a must what on earth were you thinking of giving £500 to a credit card you cant live in a credit card you must adjust to the fact you are in debt, you must get your priority payments sorted and then engage a repayment programme for your debts, you must cut up credit cards store cards, you must contact them in writing telling them the situation YOU MUST SORT YOUR PRIORITY DEBTS FIRST ,or you will end up in trouble you must keep a roof over your head, ofcourse the companies you owe wont like it but tough for them realy ,it may sound harsh but just keep thinking priority debts and me ,unsecured debts secound reguards andrew l

Why are you not paying a little but extra on the mortgage payment each month to clear the arrears ? Once you get below one full months payment arrears they probably wont bother with you very much although I would strongly advise you to clear all the arrears as quickly as possible. As has already been mentioned ensure you do this even if it is at the expense of an unsecured debt.

I'm very surprised that one missed payment is causing so much trouble...is there anything you are not tellings (I mean this likely)...e.g. have ever missed a payment before....did they contact you after the event and you ignored them?
without knowing the full details its hard to see where to go...is there someone senior at the bank/B Soc that you can talk to to discuss correcting this situation...could you try writng formally offering to pay extra each month to get you back on course? Is your arrangement with CCCS a DMP or an IVA
