Debt from Out Of The Blue...?

Hi all, Hope someone can help me with the letter I recieved in the post.

I shall type as it was sent to give you all an idea.... It is from B.M.S (Booker Management Services Limited) thier headed paper... Letter Goes...:

NOTICE OF ASSIGNMENT

Your Ref: ***
Outstanding Balance: £3955.44
County Court Claim: XA ***

With reference to the above account we are writing to advise you that there is an outstanding balance due under the account BarclayLoan - 6521***.

NOTICE OF ASSIGNMENT

We hearby give you notice that the agreement that you had with Barclays Bank PLC, Barclays Ref 6521*** (the "Agreement") has been assigned to HLCF Ltd by an assignment dated 21/11/2006. All future payments that you make in respect of this agreement must be made to Bokker Management Service Ltd.

B.M.S has been instructed by HLCF Ltd to recover the debt from you and are agents of HLCF Ltd.

DEMAND FOR PAYMENT

Please contact us to discuss this account on our debt helpline 0845 **** quoting ref ***

Should we not hear from you within 7 days of the date of this letter we will have no option other than to take further recovery action against you.

Now I was Married (now divorced) and this was a loan for the ex-wife bills, she could not get a loan due to credit so I did but she paid it. This defaulted and we did have an agreement with some agency but after we split up she stopped paying me the installments so I stopped paying the agency... After the divorce in 2005 I moved and I have rented rooms but in the last year share with a friend but the house is not in my name...... only things like SKY and my mobile.

So help and suggestions would be good....?

    I'm not sure what you're hoping for here.
    If you stopped paying it then I'm not surprised they're chasing you! Although it is your ex-wife's debt it is in your name so they are quite correct to chase you and not her.
    The best I could suggest would be to contact them to set up some sort of payment plan (although they may not want to as you have previously defaulted on one) and then you can seek to get what you can back from your ex-wife.
    You say that the house isn't in your name so there is not really much that they can do to get the money back if you don't have it but they can make your life hell by constantly calling etc.

  • Hi, I wondered if might jump in here, my daughter has received an identical letter, even the dates given are the same. It was delivered to my house, where she's not lived for 9 years and she received a copy at her current address. All she can put it down to is an overdraft she had with Barclays between 8 and 10 years ago.
    What does she do? She's worried as it gives her 7 days and was written on the 9th, with a Bank Holiday that only leaves her tomorrow to sort something out!

    I've read somewhere that if the debt is over 6 years old and you have not acknowledged it then they can't chase you for it, but you may need to check that...?
