Northern Rock unsecured loan

Hi,

I currently have a Northern Rock loan and i am having difficulty in paying it. I still owe £8500 with repayments of £178 a month. I have been paying the loan for 4 years and not missed a payment.

I have noticed they have a dedicated phone number for people having trouble with debts. Has anybody used this number. If yes, what was your experience.

    Keith, I suggest at this stage you do a CCA request, if they're unable to produce the document or they do but it's unenforceable, it places you in a stronger position to deal with them

    With reference to the above agreement, I would be grateful if you would send me a copy of this credit agreement.

    I understand that under the Consumer Credit Act 1974 (Sections 77−79), I am entitled to receive a copy of our credit agreement on request.

    I enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act.

    I understand a copy of my credit agreement should be supplied within 12 working days.

    I understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

    I look forward to hearing from you.

    If & when they return it, post it here for confirmation.

    They have 12+2 WORKING days, if after this time they fail to produce the document, you're LEGALLY entilted to stop payment until they do produce it.

    It has been over 14+2 working days. Now what.

    I have had nothing back from Northern Rock and the £1 cheque hasn't been cashed. The letter was delivered according to recorded delivery.

    Send the following letter, by recorded delivery

    Dear Sir/Madam

    I wrote to you on xx/xx/xx via recorded delivery, requesting a true copy of the signed agreement under the terms of the sections. 77(1) and 78(1) of the CCA 1974, enclosing the statutory maximum fee of £1 in the form of a postal order.

    I have not been provided with a true copy of any signed agreement under the Consumer Credit Act, despite my properly formatted and paid for request within the timescales permitted within the Act.

    I do not therefore acknowledge any debt to XXXXXX

    I will no longer be making payments against this alleged "debt" as it is unenforceable and you have no authority to claim monies from me, as non compliance with my original request this will be a complete defence to any court claim that may be issued.

    This will result in a report being submitted to the relevant statutory authorities

    What will happen now. If i stop paying the loan can they default me and pass the debt on. Should i now expect to get a hard time from Northern Rock

    NR are one of the most agressive creditors, that being said, they remain in default, if they start to hassle you, report them!

  • does this work?? I have an unsecured loan of 9k with northern rock and another with endeavour personal finance 12.5k and a shortfall from a voluntary respossession. Another query I have is on my 1st charge 2nd charge and unsecured loan never once was I offerred the option to protect my installments as the financial difficulty came about due to me being made redundant.

    I work for a fsa regulated company car insurance who offer installment protection when paying via direct debit if we don't offer it to the customer we get penalised financially and if the customer did not know about the installment protection then was say off work sick or made redundant, they could still claim it as under treating customers fairly they should have known about this product which would have helped them. Do you think this would be true with these loans I never knew about installment protection until after all the problems as my friend had it with his.
