Creditor attmepting to enforce a CCJ despite BR

Options
I got a nice notice today from Northampton County Court telling me that my case has been transferred to my local court for enforcement desite the fact that I am BR!

Am sending a copy of my order to them (creditor) telling them that it was included in the BR order.

It surprises me that some creditors will try anything

  • I love it when people waste their money like that. I received a small claim a few weeks ago addressed to me at my home address for a limited company business debt. Idiots!

Don't forget to send a copy of your Bo to the court too, they will throw the case out. I wouldn't trust a creditor to withdraw the claim.

Peachy is right. We have seen a few creditors 'forgetting' to include debtor's correspondence recently. Clerks to the Court are only human too.

I would send a copy of the summons(?) to the OR too because he will have an interest in this.

If it;s being transferred to a local court, I'd recommend that you attend the hearing. It has been known for CCJ's to be made when BR order in place -all your OR will do is send copy of BR order to the court.

I would do as others have advised and not just send it to the OR.

Oh, I had the same with Barclays - they ignored that I was BR and went ahead and got a CCJ 2 weeks into my BR. If it is for enforcement then be sure to send them (the court I mean) your BR paper.

Hubby had this. CCJ after BR. Was the Halifax for about £10k.

Make sure that you turn up in Court with the BO, and be sure to point out that you had told the Creditor repeatedly that you were BR.

While you're at it you may wish to request Court costs for travelling, administration in getting it sorted out, and lost wages in attending Court etc. Worth mentioning.
