    Wescot have today sent me a 'Final Notice' bill.

    I am going to send the below letter, but I think I need to change the last paragraph, as I have not made any payments to them for this debt... also, do I really need to report them to

    [FONT=Times New Roman, serif]I refer to my letter dated 09-Feb-10,[/FONT][FONT=Times New Roman, serif] in which I made a formal request under the Consumer Credit Act 1974 (CCA1974) s.77-s.79 for a true copy of the regulated agreement referred to in the above account number. You are reminded that you are obliged to supply this under s.189 whether you are the original creditor or not. I also enclosed the statutory fee of £1.00.

    To date you have failed to comply with my statutory request and have defaulted in respect of this account. Additionally this alleged agreement is unenforceable until such time as you come out of default or enforced by a court of law. It is a further offence to attempt to enforce this alleged agreement until such time as your default is revoked.

    Consequently I am ceasing all payments to your company until such time as this matter is resolved. It is also my intention to report this matter to the appropriate enforcement authorities.

    I await your prompt response.

    Should I change this sentence to 'I will not be making any payments'?

    ..and who is the enforcement authority?

    Is what i would put.

    and also add at the end
    ... appropriate enforcement authorities... unless you comply with this legal requirement.

    Well here I go again.. lol

    After more phone calls from Creation, I've now had a phone call and received a letter from these muppets.

    I'll get my CCA letter out again lol

    Just a couple of questions if I may.

    a) Do I make the £1 P.O. out to 'clarity', or 'Creation'? (last time with Wescot they returned it saying it should be made to Creation).

    b) Should I also enclose a copy of Creation's letter (See post 22) about their 'System Anomaly' and not being able to provide the agreement?

  • Don't bother with the PO, just send a copy of the letter as this shows that you have asked for a copy CCA before and tell them to go forth... (in a polite way of course:D)

    you are doing the right thing so long as you let them know if not let them send it to the debt collectors where they will try it on to but dont except anything they say so long as you agree a payment
