BR forms confusion

hi,

just to bug everyone again, more advice is needed and would be very grateful of some help!

okay, i have my appointment on the 22nd at the court, and have done my forms already, but i just realised that the amounts on the creditors forms will have changed by the time my court date comes, will this matter and do the amounts have to be completely upto date as of the day you hand your forms in?

also am starting to get very very nervous about going to the court, can someone please tell me exactly what happens and exactly what you have to take except the forms

oooh one last question, sorry to be a complete pain, but things have got so bad financially i am have not been able to pay my creditors at all, will this go against me, as in will they know i havent made any recent payments and maybe think i havent made enough effort? should i maybe have been making a £1 token payment anyway (dont have a cheque book or online banking and didnt want the bank to get scent that something was going on by making the token payment at the counter)

any advice would be great

    So long as the amounts are to the best of your knowledge that thats OK....TBH thats all you can do. The OR will get precise numbers anyway.

    In terms of the payments. If you could not afford them or had difficulties making the payments then say that....not everyone has a chq book or online banking so that makes payments difficult to make....esp if you take a payment to the bank to pay a creditor they will charge you extra for making it!!.

    I can`t help on what happens on the court day as not done that....will leave that to others.

    Main thing is ...don`t worry...it will be fine. (easier said than done but you will come through this)

Don't panic, the figures you have will be fine. The OR will contact everyone to get final figures, which they will probably inflat :rolleyes:

Some courts you are in and out, some you may have long waits between each bit of the process. You arrive, probably have to go through security. See the clerk who will check your forms and sort out any mistakes which you will initial. You will swear an oath to say that this is the truth and hand your money over. The forms will then go to the judge who may or may not want to have a brief 2 minute chat, the judge will stamp them to declare you bankrupt. Your forms are then taken to the clerk again who will type up your bankruptcy order and give it to you. You may have a quick chat with the OR's office just to make sure there is not any urgent things to be dealt with ie impending CCJ actions and to tell him which is your bankruptcy account. If you don't speak to the OR's clerk on the day they usually call a few days later. Hope that helps.

It means you are insolvent and can't afford to pay your creditors. Some I know haven't paid their creditors for a year before going bankrupt.

    Hope it goes smoothly for you the 22nd. The anticipation is far worse than the acuality believe me. If you have taken professional advice from a debt charity then you will have no problems what so ever.

    To follow up on Angie's excellent response on what happens in court.... they are all different but here's what happened at my hearing - seriously there's nowt to worry about.

    Day 1 - took 3 copies of forms and £510 cash to court. Went to see the clerk who checked the forms over for errors/omissions and took the fee. Made me swear an oath to say that I was who I said I was and that the contents of the forms were true to the best of my knowledge, and that was it. Total time - 15 minutes.

    Day 2 - went into the court, queued for a few minutes and was called in to see the judge. Very nice lady, asked me if I was sure bankruptcy was my only option, and made sure I knew what I was doing and had sought advice before doing so, and then signed my order. Took it back to the clerk who typed up and stamped the order, then I was on my way - bankrupt. Total time in court - about 25 minutes.

    So it was very easy. All you need to do is take (check with your court first though, most are like this) 3 copies of the forms with you, your fees (in cash) and yourself. And the rest is all sorted out later with your OR.

    Easy peasy :)

    Haha yeah! Was nice not having to hang around in court but those 24hrs between forms and judge went soooooooooooooooo slooooooooooooooooowly!!!!!

    Good advice! Courts seem to differ a lot. With mine, you only need one copy of the forms and the total time taken from start of the interview with the court clerk, to picking up your bankruptcy certificate, is about an hour.

    All our interviews are in the mornings - the clerk then faxes your paper work to the OR and they phone you in the afternoon on the number you gave on your soa.

    But, as I say, all courts are a bit different...

    Thank you everyone for all your advice. Will phone the court in the morning and just double check about the amount of forms and their own procedure etc. One more thing, can you include mobile phone bills in your bankruptcy??

Yep you can but you will loose the mobile contract & number once the provider is informed of your bankruptcy
