Advice needed on when to stop CSA payments

  • Hi my partners eldest daughter is 18 in march this year, and his has read that his maintenance could have stopped when she was 16, as she went on to college. He read this on Simple Free Law Advisor.co.uk and this states that maintenance doesnt need to be paid as college is not classed as advanced study. I am confused what is the actual age does he stop paying as he has 2 other children beside i was coming up to 16.....Please help clear my confusion.

    Certain college courses are classed as full time education ...

    Your child needs to be in full time education for you to be able to claim child support.
    Child maintenance is payable all the time that Child Benefit is being paid and the child is:
    aged under 16; or
    under 19 and in full-time non-advanced education

    The definition of full time education is more than 12 hours a week of study on a course up to and including A level standard. Some examples of non-advanced education are:
    Non - Advanced Education
    GCE / GCSE - A level / AS level / O level
    SCE Higher Grade or equivalent
    GNVQ / NVQ levels 1 2 & 3
    BTEC National Diploma
    SCOTVEC National Certificate
    Scottish Certificate of 6th Year Studies
    Foundation Arts Course
    Secretarial Course with GCSE entry
    NNEB
    Hairdressing Courses
    August GC 10th - 10th : £200 / £70.61
    NSD : 2/8

    Other posters are correct when they say your Husband's liability ends on his Son's 19th. Liability does not continue until the following September.
    However, CSA payments are made one month in arrears so your Husband will have to make one further payment.
    I wouldn't advise just stopping the CSA payments off your own back as this may put your Husband's account into arrears & then it can't be officially closed until these arrears are paid off.
    Personally, when my Son reached 19, I informed the CSA by phone & followed this up with written confirmation (keep copies), although I have to say, they were already aware of his age & told me my liability to the CSA for him would have stopped automatically.
    There's a chance you may overpay, but if there are no arrears on his account, this should be refunded. Unfortunately, this may take a couple of months.

    Only if the payments are made monthly, I pay weekly, so only a week of arrears.

    Just going through this with my Daughter who is 19 in December but finished her A level studies in June.

    I'm aware that my liability continued until Monday 06/09/10 & as soon as that date came along, I sent both a letter & and an email just to "remind" them & things do seem to be moving along.

    Hi there. It sounds like the Child Benefit will stop being paid in September, which will probably be when Child Maintenance will end too.

    With regards to some of the other posters, I'd recommend contacting the CSA as soon as your child turns 19, in theory their systems should flag up the age change, but it's no guarantee.
