Urgent Joint mortgage advice please on a relationship breakup

  • I am going through this exact situation. My partner of 8 years had an affair. We tried to make it work and altho, luckily, have managed to build a friendship, but he wants to move out and seek his independance, men! We have a joint mortgage, I have spokent to the mortgage company, both parties are liable for the mortagage until the house sells (ours is on the market and urs should go on too) that however needs both parties to agree and sign.

    My partner is wanting to move out and rent a flat, his outgoings will consume all his wages if he does this and will nto be able to pay his halp of the mortgage payment, leaving it on my shoulders, I cant however afford to run this house alone when his wages will be gone on a 1 bedroom little flat! so im worrie dto death. I spoke to the mortgage company and yes if only half the payments are being made they are going to into arrears nd they wil start to chase for the money BUT if it went to court if she can show she has kept her half up and has been making regula rpayments it will help, altho stressful and an absolute nightmare, they will not just reposess your house if you can get around it and they wont treat both parties equally in this type of siutation if she can pay her half. BUT the problem is she cant rent and pay so is it not possible for her to move home with you? or just rent a room somewhere? i dont know what area you live in and cost of renting ect. but if she can try and stick out living there and stick out paying her half then try and encourage her to stick it out.

    As for the bank account if it is in credit you can remove a name but both parties must agree to it.

    There are ways arond things leagally but then u have a soliciotrs bill to pay so try and deal with things in house. He needs to know that it affects him too and not to act stupidly. Sounds like he needs to be knocked down a peg or too.

    Kavanne is correct, the bank will put a complete freeze on the account, no-one can do anything!
    Had to do this recently when a business partner, started to put his had in the till.!
