Help needed about scs credit problem please!!!

Hi, i was just wondering if it is possible to cancel a credit agreement if scs (sofa company) sell you a 3 piece suit, even after telling them that i only work part time, plus my girlfriend is out of work due to illness. I was however assured by the customoer service rep that everything would be fine as there would be nothin to pay for 6 month, clearly the salesman was out for commision and didnt give a thought to the circumstances of the person he was selling it too. I know it was a mistake my myself for entering a contract while being short on money but after trying to find a new job with full time hours i have been unable to. So i was wondering if a company can be at fualt for selling something on credit while knowing that person is in financial difficulty? And if so how or where do i start to cancel the agreement as it has been 4 months and i will have to stat paying £70 per month starting in 2 months.

Any help or advise would be greatly apreciated!

    I doubt the saleperson approved the loan. Providing nothing was altered by him on the application then the lender would have approved you based on their own criteria. This is likely to be based upon the contents of your credit file and what you delcare to them on the application (time in job etc).

    The responsibility for ensuring that a credit transaction is affordable lies mainly with the person signing on the dotted line.

    I agree that under the heading 'Irresponsible lending' comes the matter of lending money where a person clearly cannot repay, but I assume you were working at the time for the application? Proving irresponsible lending against the lender would be an uphill struggle I suspect.

    Well i was working part-time at the time which i still am, but my girlfriend (who's debit card was the one approved) was not working at the time, she told the salesman she was a student, but the saleman said that if he wrote that down it would be dissaproved, so he wrote waitress instead! Is that allowed? Like i said i dont really know what chance i have to cancel the agreement but surely if she is a student then thats what has to be put onto the agreement?

    There is no get out here - you signed a contract and now have to abide by its terms and conditions.
    The shop could just turn round and say what you were doing going to a sofa shop if you didn't want to buy a sofa just as you can't blame Tesco if you buy too much during the weekly shop.
    Not good news I'm afraid but if you can; get a 0% card to transfer the debt onto to minimise your interest costs. If you stay with SCS finance they will sting you for a lot of interest.

    Whilst what the saleman did was obviously quite wrong and inexcusable (and should have been the subject of a complaint at the time, but I assume you must have been really desperate for that sofa), I'm afraid that you have been complicit in this by signing the forms knowing that the information provided was false.

    I would keep quiet about this to the lender if I was you - they could add a CIFAS (anti fraud) marker against you and then your problems would really start :eek:

    Sadly you signed the agreement. Credit can be obtained through DFS, SCS etc if you are on income support right or wrong it is classed as income. I do sympathise with your situation but I cannot see you getting out of this one. Having said that have a look here www.natioaldebtline.co.uk and give them a ring, they will be able to advise you over the phone as to how you stand legally but seeing as the credit act was changed for 2007 i can't see you winning this one.

    It is not illegal to open another persons mail unless you intend to commit fraud - this is frequently incorrectly posted:)
