Help Needed!

Hello,

Basically I am subject to a court order which ordered payment of £75 a month till the debt was cleared. I have not defaulted in 2 years but now have experienced a change in circumstances and cannot pay such a large sum. I wrote to the Reston’s Solicitor acting on behalf of HFC to advise of a change in circumstances and enclosed a financial statement. Today I received a response saying they have received my letter but and that payment is now due with the court order attached. If payment is not received by 15th April they will look to enforce the judgment by one of the available methods. Does anyone know what will happen next?

If you can no longer afford the payment under the current court order,you need to complete form N265 available from the court and this enables you to ask to pay a lower amount,you will need to put your income and expenditure on this form,you may have to pay a £35 fee,this depends if you are on certain benefits etc,take this form into the court and they will look at it,if the court decides that is all you can afford,he/she will make another order with the lower amount on it.Good luck

Thank you for that. I expect that the court will be a little more sympathetic to my circumstances, I really hope so!
