Cabot 'can't locate' my CCAs 'yet' - as 'gesture' puts account on hold

Hi folks
Anyone else had the standard ''can't find your CCAs" from the original lender... as a "gesture of goodwill" have put your accounts on hold......"?
Have three accounts managed by Cabot (2 Halifax, one Monument/Barclaycard.....) so the letters received were all identical and arrived on the same day...
Just wondered if this indicates the original CCAs are still on their way, or the paperwork has gone out to pasture as they say....
Also - have saved some money so would it be a good opportunity to offer them albeit reduced (ie 30percent) full and final offers?
Advice please.....
Thanks
SebW.

That is Cabot standard [STRIKE]set of lies[/STRIKE] attempt to mislead you over their obligations.
They are obliged to comply. Goodwill has bu**er all to do with it.
Everyone gets that if Cabot can't immediately find the agreement.
Not possible to predict whether they will find a CCA at the moment. As said, it is their standard letter and as such doesn't really indicate much.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

i recieved a letter from cabot after sending request for cca they sent letter saying they should beable to locate it a week after the 12 days have passed i have county court papers and know cca can anyone help please
bump this up
teabag, you really need a new thread - nearly missed this.If you've have not made a mistake, you've made nothing0 -
Cabot have been unable to find a CCA that I requested nearly 12 months ago. I have just had a letter of them saying ,that they have been provided with statements from original lender. In their eyes this means that this constitutes a clear acknowledgement of my responsibility to repay the debt. Also by paying Cabot money before I applied for CCA they also say that this is an acknowledgement of debt.
They then go onto say;
'In light of the above, Cabot is of the opinion that you have been provided sufficient evidence that the account exists.'
Then they ask you to ring them (as if )to discuss options available to settle account.
I shall be ignoring this threat.0 -

I have been having similar dealings with Cabot. They were sent a CCA request at start of year. They have replied a couple of times saying they are still looking into it etc. Yesterday received a letter with statements enclosed. Have not got letter with me but says similar to above - your statements prove debt exists etc & settle account within 14 days.
What do I do now?? Should I send a letter saying that as the CCA has not been sent the debt is unenforceable?? Any advice would be appreciated . ThanksJan 23 - Leona Lewis Tickets0 -

Have had a reply on another forum and someone there said they had received same letter a few months ago and have not heard anything since. So I am going to wait and see if anything happens.0 -

Just had areply on other forum, says as follows.
Note the wording.
'In light of the above, Cabot is of the opinion that you have been provided sufficient evidence that the account exists.'
Was anybody ever disputing the account existed ? What is in question is whether an agreement containing all the prescribed terms and therefore compliant with Section 61 (1)(a)exists. Without such a document, the account is unenforcable at law.
There is no connection between proving that an account exists which may or may not have done and proving that is enforcable at law.
Hope that helps.:T0
