Rbs credit agreement

I :confused:have used the template letter to RBS asking for a copy of my loan agreement, I sent it recorded delivery which they received 10 March 2009 along with my £1, I also stated that until I received my agreement that all payments would cease, I still have had no word and they have took the payment from my RBS account they won't let me cancel the direct debit.
Any ideas to my next step

    Hi Hannah

This is about par for the course most lenders do not respond in the timescale they should.

1 I would put in writing to them a follow up letter chasing the agreement, 2 Check out the consumer action group forum for help and letter templates.

If they dont cough up with the goods consider getting a solicitor involved either via a claims firm or direct.

Lenders sit up and pay a bit more notice when there is legal representation involved.

    Hannah,

Not clear exactly what you are looking for here. If the loan has been fraudulently made and they are taking payments from you, then invoke the direct debt guarantee and get the money refunded by your current account provider.

If you are hoping that they won't be able to find the credit agreement, but have received the funds and been making payments, then it isn't quite as simple.

You won't just be able to get the loan written off or stop payments just because you put it in writing.

You have a contract with RBS to keep making payments until such point as a court or other body decide than the contract is nul and void.

    R.
Smile :), it makes people wonder what you have been up to.
