Hi all
I wonder if someone could point me in the right direction please.
I read all the information on money saving expert about reclaiming council tax if you think you are in the wrong band. I followed all the instructions and it came out that my band may be incorrect.
When I purchased my property, from new, I objected at the time and it went to court in my absence and the band was found to be correct at the time, this was back in 1993. This week I contacted my local council and told them I wanted to have it checked again as I still this it's incorrect. The person told me it must be correct as it was set by the courts back in 1993. Is this correct and can I still have this looked at.

The council are not responsible for seting bands and neither are the courts - the Valuation Office Agency are responsible for the banding and any associated changes/queries.
A court would not rule on the banding as it is not in their remit - a Valuation Tribunal can rule on appeals over banding but they are not a court. If they have already ruled that the banding was correct then it would take a lot of work to have that overturned after all this time.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -
The Valuation Tribunal hearing was often referred to as a "court", as in a previous incarnation VT was called "Local Valuation Panel" and hearings were "Local Valuation Courts".
After such a long period of time a VT will not review its decision. You cannot make a further appeal as you're well, well out of time. You would have to provide pretty convincing evidence for VOA to consider reinvestigating band as they would have fully investigated it before preparing their case for the VT hearing.If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0
