    I understand that just wanting to know what will the court need at this hearing I & E Wage slips ,bank statements??? the mortgage and debt is in his name does he still include my income can i write saying me and the kids live in the house as well?

    Yes he has one other credit card had a ccj for that in 2005 and have been paying £90 per month ever since to that one

    Yes, you need to show a breakdown of what you can afford.

    is there anyway to postpone the court hearing as he needs to sort out time off work and will the court send him any paperwork to complete before the hearing???

    No, but he will need to explain how the bills are paid, i.e Gas £50.00 / 2 = £25.00

    You can write to the court requesting a change of date due to XXXXX

    From the way I'm following your thread, it appears that an interim charging order was awarded in 2007, and has remained an interim CO until today when the creditor has decided to make it a final CO, correct?
