interesting call from mortgage company

Had an interesting call from mortgage company the other day.

The mortgage relates to a house i rented out, havent paid mortgqage for ages and they have a reposession order on the property.

When i had my OR interview he asked me what was happening with the house so told him details as above.

I sent a copy of my BRO to mortgage co after BR to avoid them chasing me.

Then last week i had a phone call from them saying they had my letter and could i make a payment or clear the arrears!!!!!!! So i said that the point of BR is that i have no money and currently no job and they shouldnt be asking me for money. I informed him that they had a repo order and that maybe they should just repo it! He said he didnt like my tone. I didnt like his so i hung up! I was so annoyed that they had the gaul to ask me for nearly 5k when they knew i was BR!

Anyone else had this problem? Surely i could have got in trouble if i had made a payment if i had the money as it would be showing favouritsm???

    Hey flowergirlgush just out of interest was the mortgage u had fro the property concerned a residential one or was it Buy To Let? Did the OR actually look into all this stuff?

  • pretty sure it was buy to let, cant remember now to be honest. Its always been rented out so i assume it is.

    OR didnt seem too concerned, to be honest, i think they must have more interesting cases than mine as i never hear off him, havent even had the paperwork they send out to you and its 11th feb since i went BR and i havent posted all my paperwork to him yet either! Must do it this week!

    Even though you are BR the mortgage company can continue to chase you for the debt until the property is sold. Its because the mortgage is a secured loan and as such is not included in your BR, of course any shortfall will become included once its sold.

    Even though you are BR the mortgage company can continue to chase you for the debt until the property is sold.

    But you can tell them to "get stuffed", and there is nothing they can do. :D

  • thanks fermi, thats pretty much what i did :D, i mean, do they think you would go through the whole BR ordeal and then have a secret stash of cash that you think the OR might not find! unbelievable!

    If there is no equity in the house the OR is not interested in dealing with it. It is between you and the mortgage company, so as Nervous Mother says until it is sold then they can chase you as much as they like. But as Fermi said you can tell 'em to Foxtrot Oscar and in fact you did :D

  • i did tell them to go ahead and repossess it as they have had the repo order for months. The same company was quick to repo another one of my houses which would have sold for a good price and cleared the debts, instead there was a shortfall which has gone into BR so i have no sympathy for them now trying to make arrangements for me to pay it now. Maybe if they had been more sympathetic in first place i wouldnt have been in such a mess!
