  • Why is it defective? Not sure how best to proceed with this now? What do you mean?
    Have had two further letters regarding this account. Another Default type letter and then the Solicitors Letter. Should I PM these to you. The letter i have posted up is the first one we got back in the middle of last year.

  • Ok thanks. On with it now should be with you in the next 10 mins or so. none of the others actually say Default Notice on them. They appear to be further demands but i'll PM you what i have and see what you think.

    Sorry for the delay had an unexpected visitor so came away from the computer apologies. That letter was dated 11th february 2009.

    That letter was dated 11th february 2009.
    So that's the latest default letter, again, it fails to meet the correct legislation, so can be beneficial to you should they commence litigation.

    As for the solicitors letter, it means nothing due to there "client" not complying with legislation, should they commence litigation (which is every possibilty) your defence will be the defective default notice.

    Once again, it's for you to decide to take the option that best suites you.

    It's not for you or anyone else to educate them on what the correct legislation is when issuing a default notice.

  • Thankyou. But I have no idea myself as to why it is defective. Should i go and see a Solicitor? I can't defend it at the moment because i have no idea what my argument is. I know you say it's defective but why?
