Hi all,
Just a quick one but could anyone give me an answer to my queiry?
I sent a letter to Capquest Debt Recovery Limited on the 16/03/09 and recieved a reply from them basically saying that the account is on hold for 28 days whilst the obtain the info required.
My question is:
1) As I have now waited the 12 days plus the 2 days am I able to now send the next letter stating they have not complied and about the 30 days default.
I ask this as their reply mentioned it's been put on hold for 28 days - so I wondered if that means I have to wait too.
2) And finally if I am still within my right to send the non compliance and 30 days default - when do I count the 30 days from?
Is it 30 days from the day I send the next leter or is it 30 days from the original date I sent the CCA request, ie. 16th March 2009??
All your answeres would be gratelly appreciated.
Many kind regards for reading
Chris

You can send it if you want.
How long they put the account on hold for has no effect on your legal request.

The "offence" after the extra 30 days no longer applies.
The law changed to remove that a short while back.

Thanks fermi.
Could you tell me a bit more about what you replied back - when you put,
The "offence" after the extra 30 days no longer applies.
The law changed to remove that a short while back.
What do you mean by this as this is the first I have heard.
I thought that after the 12+2 days I could send the next letter saying they have not replied and now have the 30 days etc.
Is it possible you can kind of give me a step by step to requesting cca?
Any help again would be much appreciated.
Regards

Thanks fermi for the link - much appreciated and can see what you mean about the 30 day time limit not meaning anything now.
Just one more question though:-
As its been 12 + 2 days since request of CCA, (and the only reply has been a letter back detailing they have put account on hold for 28 days), what would be my next letter to send to Capquest as the templates I have downloaded have obviously got the wordings with the 30 days detailed in?
I there another template with the correct wordings in?
Your reply would be most appreciated.
