relentless phonecalls!

Hi all, i wonder if anyone could give me any advice about a certain company that wont stop ringing me. They are always very rude, threaten legal action and demand payment each time. I have told them i am with payplan, and have informed payplan my debt now lies with them. Payplan say my financial statement has been sent to them, they phone and say it hasnt :confused:

They phoned me last friday, and this time i took a fax number for them, to pass on to payplan to fax my sheet to them. Fair enough. This call was at 6pm, so payplan was closed for the weekend which i told them. I then got a call on saturday from them, payment demands. Sunday was quite. First thing monday morning i get yet another call from them, asking for payment. I did get a bit mad and the call didnt end nicely. How can i get them to back off please, i am doing everything i can and have been compliant with them from the word go. I currently have 3 children under the age of 4, and these phone calls come at all times of the day.

    Harassment by telephone

    I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.

    I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)

    I now require all further correspondence from your company to be made in writing only.

    I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

    If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

    Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.

    Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

    oh thank you thats a great help, I will get that sent off today. I have already told them I wanted to be contacted in writing only so now they send me letters AND phone! Hopefully that letter will put a stop to the calls.

    I have had these calls since December and they ring at all times of the day and night. I have written twice and got nowhere with them.
    I owe money to about 8 different companies and they all seem to resort to ringing. To day I have had about 6 calls from Mercers about Barclaycard I believe, when I asked why do they keep ringing,the girl answered
    " Because I can " So I told her to get a life and get a decent job.
    Previously to this I have had other calls where I have been lectured by someone fairly young about my responsibilties !
    They should be banned from carrying out this practice of ringing people.
    It is definitely harrassment.

    I had similar a few years back from the Halifax and they often had no record of the calls. Apparently the only record as call, any calls that are answered (and they are allowed to make 3 a day according to them!). So, all the unanswered calls which ring and ring and then cut off when you answer them are not recorded as calls. You could be shouting, "Hello..............Hello.................Hello..................Hello........." down the phone and that still doesn't count to them.

    Eventually I switched my phone off and it stayed off for 2 years.
    Almost debt-free, but certainly even with the Banks!

    When these companies call , they ask ," may I speak to
    " . I ask whos calling ? I then ask them to hold on a moment . I then put the phone next to the TV , leaving them listening to LOOSE WOMEN , or better still Balamoray !
