no, they credited the money directly to my bank, i didnt even notice till a couple months after!

i have so much goin in and out i get confused :S my finances are a bit messy (but my business books are very tidy :P) i have a complicated life, what can i say

I reckon if it is the HMRC's error then you should be able to get the fine back- HMRC do make mistakes sometimes - but it sounds as if part of the problem is you are disorganised and you need to work out what has gone wrong.
I don't think you need a solicitor but a chartered accountant could probably take a look at your paperwork (hopefully you have it) and work out what has happened...
If you don't want to do that you could simply write a letter again to HMRC explaining the situation and asking them to clarify why they credited the £700 to you and then demanded it back plus interest. (bearing in mind it might take a while to get a reply)
This is probably more practical then trying to find some loophole...0
