I have probably missed something here. Are you in employment?
Its not going to help you much if you cant speak these companies without a phone. Can you make some payment towards the phone bill. I don't know for sure but that may stop the phone from being disconnected. Can you post the phone company name on here, someone might know what their disconnection policy is.

We're with BT and it's already been 8 weeks since the bill was due. When I've tried to make an online or phone part payment it says it needs the full amount - so I'm kinda stuck. Would be good to know if there is a way around it. I did try going on the monthly payment scheme, gave them all the details and for whatever reason, it wasnt set up properly. Next thing you know, another bill has arrived.
Yep, both me and hubby working. We both lost our jobs last year (hence all the difficulties) but managed to secure other, although lower, paid jobs.

I hope you are feeling a little bit better today.
MCS' favourite threat, attachment of earnings, was something I heard a few times while I was with them. They make it sound so easy... But actually the following must take place before your husband's place of work gets a letter.
1. They have to apply for (and be granted) a CCJ. If it gets to this stage, you must post for advice. This process takes a few weeks at least.
2. The judge will have set a payment plan. You must keep to this. If you do not, MCS have to apply for enforcement. This can include attachment of earnings or a bailiff getting involved.

So there are opportunities along the way to prevent MCS getting one and it is far more complicated than they want you to think it is.

I do feel a bit better this morning, thanks.
I did think that that was the process they had to go through first but needed to hear it from someone else - you know, when you doubt yourself what's supposed to happen. I know that the CSA can automatically get an attachment of earnings order and was pretty sure that a debt collection agency did not have the same authority as a government body to enforce that without having to go through court proceedings properly first.
I just wish it wouldnt have to come to any court proceedings. I've contacted CCCS and advised them of the "threat". Do you know of any success with Metropolitan agreeing payments with CCCS? I'm just wondering what kind of chance we've got of avoiding court proceedings

I deal with Metropolitan in regards to paying off by HSBC overdraft.
They kept on allocating my payments to the wrong reference number at their end of things.

Hi Sunshine. I am glad you are feeling a bit better today.
I wasn't involved with them for long. They set a direct debit up and for reasons at their end, didn't take any payment. I phoned them just after the second missed payment and pointed out thier mistake.. About 2 weeks later they sold it on.
At all times they were reasonable (much better than trying to deal with HSBC) and I never got Manila. Reasonable, apart from the empty threats anyway...BSC No 248

Thank you, it's always good to hear about other people's experiences. Fingers crossed we can find an amicable solution. If it ends up going to court then I should worry about that at that time and not waste precious time worrying about that at the moment.

Hi Sunshine, going back to your BT issue, prehaps you could pay them by internet or telephone banking. Ie send the payment, (as much as you can), rather then get them to debit it. Hope that makes sense. That way they will receive it and wont be in a position to refuse it because it will be in their account.
Dont worry about the attachment to earnings issue. Im guessing that you are paying your pay into your HSBC account anyway so they already have the money so to speak as MCS is HSBC anyway.
There is a slight possibility that they will request for an external agency to collect. Again, you do not have to worry about that, just post on here.0 -
