Hi Sandee
There are a few things you may be able to do.
Have you requested a copy of the customer credit agreement (CCA)?
If the agreement was made before 6th April 2007, it must contain certain terms for it to be enforcable. Did you sign an agreement for the catalogues?
I would also suggest claiming back any charges they have made against you. If they have made quite a few, it may be better to ask for a subject access request (SAR). This falls under the Data Protection Act and you will be able to get a copy of all transactions as well as a copy of the original signed credit agreement - this costs £10. A CCA request costs only £1, but they are not required to provide a copy of the original agreement - only the details that should have been on the agreement and they are also not requires to provide a copy of your signature on any copy they produce.
What this will do is question their authority to enforce the debt, not the existance of the debt. If the debt is unenforcable, then you will not need to make any payments towards the debt until it becomes enforcable again - which will only happen if they can produce a copy of an enforcable CCA.After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91
Dad Gift 6k ¦ Savings & Inv Tst: £2,500
Loan 10k: £0 ¦ Dad 5.5k: £2,270 ¦ LTSB: £0 ¦ RBS: £0 ¦ Virgin £0 ¦ Egg £0
Total Owed: £2,270 (+6k) 11/08/20110 -
Hmmm not all are so bad - I owe studio £190 and lost my job - I couldn't pay a thing whilst on jsa - 1 call to them and they froze the account - no charges, fees etc.. and accepted 50p a month until i got back in work.
Now I have a job and am paying back £15 a month again.
They couldn't have been nicer. Not really comping any more as too ill - but hoping to win £1000+ in 2017 in cash prizes - watch this space!0 -

Hi, what does this mean? that all they have to do is send me the terms and condtions of my agreement? as it doesnt have to be signed what use is this? I mean couldnt they just send me a print out they just made five minutes ago? Im trying to find info on cca requests but there is so much and some of it isnt valid anymore, Im a bit lost!
ThanksNovember £10 a day challenge. Im starting early- 66p so far!0 -
Then that means they have not fulfilled your request to receive a true copy of your credit agreement. It's a typical fob off letter from what you posted.Hi, what does this mean? that all they have to do is send me the terms and condtions of my agreement?
Going to be short - yes! I could go into other things that can be got up to but you probably already know those.I mean couldnt they just send me a print out they just made five minutes ago?
Oh, who says that? A DCA or a creditor? Maybe a bit of 'encouragement' using the OFT guidelines on this may 'encourage' them a little more. Though it may depend how or which year you applied. But, how can something be binding unless it has your signature on it? Anyway I am sure others here will either correct me or point you in the right direction. But to me, your reply looks like a fob off!only the details that should have been on the agreement and they are also not requires to provide a copy of your signature on any copy they produce."
PS Might be better you start your own thread or it will only confuse things for the OP on this one and your own issues.Any help, opinions, views I may hold those are my own. Respect them as you would expect the same in return. Offered freely, is gleaned from a lifetime of experiences, knowledge gaining. Passed on to benefit others. I may be direct, ask you questions but those are to help you. Up to you if you choose to take it. I won't judge you either way.
