Moorcroft/Natwest Credit Card

I owe £230.35 on a Natwest Credit Card - the debt was passed to Wescot when I lost my job and had only job seekers as an income - I sent a soa and everything and they wouldn't accept £1 payments or freeze charges etc...
I was unable to make payments and the account got passed to Nelson Guest and Partners Solicitors - who said it was ok to pay a pound a month and start paying more when in work, which I have been doing...
Now I have received a letter from Moorcroft saying they now have the debt and are threatening legal action within 7 days.
I have just started a part time job with tesco's and don't get paid until the end of next week and even then it will only be my first week of money approx £90-£110. So I can't pay in full and can't even call them until then as I have no credit.

I have been on their website and paid £1.25 by card as it is all I have left and requested a payment book and filled in an income and debts sheet etc...

Is this enough of an effort on my part to prevent them taking legal action?

I intend to call at the end of next week with a payment over the phone of £10.
Not really comping any more as too ill - but hoping to win £1000+ in 2017 in cash prizes - watch this space!

    First things first, cancel your card details, they have NO right to them, never ever trust a DCA with your card details, at present you don't have the funds to pay them, you can however, send them a token payment of £1.00 via postal order made payable to "Moorcroft"

    The letter is a threatogram, which in this case has worked as you've paid them via their website, don't allow them to intimidate you.
    I intend to call at the end of next week with a payment over the phone of £10.
    Never, ever, call them, you can't offer any more at present, if you call them you'll be more stressed after the call than before, they really won't listen or be interested in what you have to say, unless of course it involves money and the individual being able to reach their target.

    One other point, to stall them in their tracks, send the following CCA request of to them, this will keep them off your back for a while:

    Dear Sir/Madam

    Re:− Account/Reference Number: XXXXXXXXX

    With reference to the above agreement, I would be grateful if you would send me a copy of this credit agreement.

    I understand that under the Consumer Credit Act 1974 (Sections 77−79), I am entitled to receive a copy of our credit agreement on request.

    I enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act.

    I understand a copy of my credit agreement should be supplied within 12 working days.

    I understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

    I look forward to hearing from you.

    Thanks very much - I have tried requesting the credit agreements previously and have never heard back - now it's swapped companies do I have to do that again? Do I have to send it recorded delivery? Because I really can't afford that at the moment.

    Yes, if the answer is no above
    IDo I have to send it recorded delivery? Because I really can't afford that at the moment.
    It's always best to send recorded delivery as it proves they've received your request, however, if funds are tight, take your CCA letter to the post office and ask for a "Proof of Posting" certificate, this is free, the only downside to that, it proves you sent it, but no confirmarion they received it.

    No for the last cca I didn't send recorded or do the certificate of posting - so no proof.

    It's not like I am trying to get out of paying what I owe - I just wish they'd be a bit more understanding. The whole time I was on job seekers (4 months) I got endless calls and letters and couldnt pay a penny - couldnt even phone them as had no money for phone credit.
    Now I am in work - allbeit part time I can start paying back what I owe.
    Not really comping any more as too ill - but hoping to win £1000+ in 2017 in cash prizes - watch this space!
