Welcome Finance - Bullies have started!!

Please could somebody help, as I really dont know where to turn

Of course its yet again WELCOME Finance and the bully BOYS.

I purchased a car on Hire Purchase from Car Craft in August 2007, I paid a £1000 deposit, and the car itself was £6000, the total value of the agreement a shocking £14809.00 I have maintained all regular payments of £310.41 per month since then to the end of Jan 2009.

My employment ended and I have no further funds to pay for the car, I am aware that I have payment protection but the Guy told me that is for people who have been made redundant only. but I have to telephone the insurance on Monday, but they could not stop the colection bullies calling round!!

I recieved a letter from Welcome saying I has missed one payment, I came home and found that the Bully Boys had somehow entered my place of residence how I dont know and let a letter on my front door, asking me to contact them, the letter is dated 26/03/09.

This morning I am scared as I have had banging and banging on my front door, to the point, of where I am so frightened I may have to call the police.

I telephoned WELCOME asked who these guys were he said they were from the collection department, they will hang around and not leave till they take the car away,.The car is parked on a private driveway.

I have missed 1 payment, but the 2nd is going to be missed shortly.

I do believe they need a court order now? as I have paid a 1/3 of the amount.

PLEASE could someone help me...

Should I get help from a Solicitor, would they help as I am unemployed??

    how do you know they were in your residence
    i think i would be calling the police
    if they were in your house can they not be
    charged with breaking and entering

    Sorry they entered the block of flats, which have a secure door entry system, they left a letter wedged into my front door.

    I think I wrote that incorrectly, but they still got in on private property!

    you say your employment ended. What do you mean - were you made redundant?
    If you will the end, you must will the means.

    My contract ended, when I took out the car loan I was in employment, but since last July long term employment without breaks.

    They may have been removed by the Mods.

    You have 2 problems here. both of which you need to know your legal rights for.

    1 Most urgently - the collectors.
    2. The car. I would phone one of the debt charities if you do not get a sensible answer today on this one.

    The collectors will not be baliffs if they have not been appointed by a court. But since they are trying to reclaim property owned by someone else, I don't know what their extra rights are, if any. There might be something on Herbie21's site here:

    The guys were representatives from Welcome Finance! To help me sort out the payments!, so why 2 of them had to walk around the car and inspect I dont know.
    Next time I see them (probably 2morrow) I will be taking photographs of them
    just in case of any accidental damage to the car!!

    I have looked at the 1/3 amount, on the HP agreement, and I have paid well over the amount, so to take the car away, I am right in thinking they would need to obtain a Court order?
    I have just defaulted on 1 payment, but tomorrow I am telephoning Direct as they deal with the PPI for Welcome.. and I have seen by other reports they are useless:angry:
  • what ive found with welcome finance that theyre pretty macho when hiding behind there mobiles and works phones,they target the vunerable and when faced with a customer who wont take there crap they turn to jelly lol
