This is what cabot sent me today in response to my cca request.
It did contain my signature which ive blacked out could someone please check the validity of it.

    As it stands, mark, that 'application form' does not appear to be a true copy of the executed consumer credit agreement, as required under the terms of the Consumer Credit Act, 1974:

    thanks rog

    It was a old providian cc that changed to monument then cabot bought it off barclaycard.They sent me full soa although i only requested the cca and with it was monument ts and cs but no prescribed terms no credit limit etc

    I doubt very much that a cca actually exists.

    Can you remember when you made the last payment, or written acknowledgement, to this 'debt', mark?
    If it was, as I suspect, over six years ago, then it is more than likely that the 'debt' is Statute Barred, anyway, and no longer pursuable through the courts:

    I Have been making regular payments to cabot so its not statute barred.
  • Not gatecrashing anything but as far as I know you can stop making payments at any time until a proper CCA is produced. Though others will correct me if I am wrong. Which I don't mind because I learn more that way. Oh, sorry, I am treading on others toes by offering any help I see. *tosses eyes*. Didn't realize only certain people on this forum were allowed to for example. I shall mind my P/Qs in future.

    The account is in dispute and they have had the 12+2 letter so i have stopped making anymore payments until they produce a signed true copy of the original agreement.

    mark that is what they send me back mine was with lowell though i was not trying 2 get out off paying the money i owed there were really not nice 2 deal with that was going back in november last year in the end i got a letter saying that because they havent got a cca just an application form witch was the same as yours they have written the whole balance off because they new they could not enforce it good luck though

    Cabot sent me the same application form saying it was a complete CCA as my signature was on the form agreeing to be bound by the T&C's. They are still hounding me though, why do they hound some people and not others????

    Have you reported them to either the Office of Fair Trading (Trading Standards) or the Financial Ombudsman? :confused:
