who's responsible ?

have bought an item from ebay , £380 which arrived damaged ,
have been in contact with the seller who seems very genuine that the item was not damaged when he posted it .
it was sent by parcelforce , which i believecovers an automatic £150 insurance - the damaged component is probably around £ 80 - £90 .

who is responsible for claiming this from parcelforce ? the buyer or the seller ?

he has intimated that he will send on the details for me to claim ......... but i would have thought that would have been his responsibilty , as he entered into the contract with parcelforce .

can anyone advise. thanks

    The seller.
    You didn't ask for it to be sent by PF, you just gave the money to the seller in return for having the item delivered to you in good condition.

    The seller is 100% responsible.

    He/she should refund you fully, but you may have to cover the cost of return postage.

    Did you pay by PayPal? If so then you have them on your side :)

    It's the sellers responsibility, however I think return postage is still on you.

    If it's an easy fix, prehaps ask the seller to refund repair costs so you can keep the item. Will save them having to repair and then re-sell. They can then claim it back from PF.

    thanks for the replies folks.

    Astec -yes it is quite an easy fix and i would be happy to keep the item , once the damages have been rectified.

    Just wasn't sure if there was a time limit within which i had to return the item.

    I paid by paypal , shoiuld i inform them there is a problem ?

    No it isn't, if buyer is not at fault you should never end up in a worse position than before the transaction took place. Getting them to pay it, however is not always that easy.
