story of a NRPP

Hiya all fairly new to this site but i have been reading loads of posts

i SO wish i'd found this site earlier

I met my hubby in 1996 and after a few weeks he told me that he might be a dad. he was never sure if he was the father cuz he found the PWC sleeping with other guys thats why the relationship broke up. he had already signed the birth certificate cuz he believed he could be the father(at the time) and they were still in a relationship(at the time)

in 1997 we recieved a letter from CSA and he replied not sure if his child will do DNA never got any reply didnt hear from them at all

late 1997 we had child 1
1998 got married
in 1999 we had child 2

in 2003 oct we(he) recieved a letter from CSA again parentage disputed was told to do DNA he did by january04 started saving a little just incase

hubby rang CSA repeatedly in Jan Feb March April to see how it was going and if PWC had taken DNA test

on phone "no and case will be closed if she doesnt comply" HOW i wish we had that in writing what a believer i was

so we stupidly believed after ringing them again that the case had been closed (thinking she hadnt done the DNA as she wasnt sure if it would come back positive)

we went on a little holiday with money we had saved

i went to work for 18 months in 04/05

moved house in aug 07 got new contracts with bt and sky (18 month) and carried on with our little life hubby working again on WTC CTC CB and crap wages
oct 07 got letter from CSA wanting hubby to do another DNA PWC happy to take it now so before xmas hubby had another day off work and sorted out DNA test

Jan 26 08 6 letters through door yes parent back pay requested from oct 03 (£6thousand odd) WHAT?? please pay £ 25 per week please pay £34 per week please pay£51 per week please pay £63 per week WHAT???
so i rang CSA got authority to speak on hubbys behalf and asked what was going on

case had not been closed case was backdated cuz shes on benifits(if she had been private cust case would have been closed)
PWC had mitigating curcumstances why didnt go for test in 03/04 (which we now fully understand and dont disagree with,one of her other children died xmas 03)

the £63 a week was what they wanted us to pay we didnt have it £10 DNA £27 on going and £26 back pay
told them couldnt afford it straight away(low income WTC CTC CB) will start with payment of £15 and increase asap

if gov realises that we dont have enought money to suport 2 adults and 2 children and give us benifits how can they expect us to make it work for 2 adults and 3 children

she gets the CTC and CB


no not good enough will start DOE if dont pay

disagreed with working out
hubby doesnt get xmas bonus every 5 weeks wages are not £300 pw they are £215pw now ongoing £23 so total £59 pw

i went to the CAB haha they offered me a voluantary job as i understood it better than they did

looked into back pay as well as started an appeal re back pay we complied she didnt why are we penalised why wasnt case closed when we were told it was (we have no prof no letter so lucked out) why is the effective start date not oct 07

3 weeks of £15 and 1 week of £21 later DOA letter arrives

taking £59 a week out of wages

rang my mum in tears " they will take our kids off us what do we give up cant give up home phone or sky as new contract cant give up car as live in middle of nowhere if stop paying rent house taken off us kids go into care if stop buying food kids go into care" i was in a right state "speak to CAB" said mum haha!! "ok speak to MP"

spoken to MP will look at case didnt actually do much that i could see imho

hubby getting realy stressed with situation and depressed saw doc 04/08for new docs appt(moved house aug 07new doc) doc took 1 look at him and signed him off work for 6 wks(work was stressfull aswell) then his knee started playing him up and he hasnt been back to work since

rang CSA was told "on sick pay no need to pay back pay or DNA costs while on sick £5 per week

great i thought

finally appeal was held not in our favour mitigating circumstances and claim cant be stopped while on benifits still not fair seeing as we complied now we get penalised i even said that had we known case was still open we would have hounded them (CSA) to get it resolved so we could pay and not get a debt was told we had done everything we could but government leglistation ment case couldnt have be closed

great where do we go from here

wait it gets worse

cuz CSA said dont pay back pay or DNA while on sick, we didnt, so we were summoned for a liability order(LO) re the back pay its been resorted down to £4500 but still wow

i started a self employed job delivering catalogues didnt work was paying out more than earning

hubby had operation on knee oct 08

sick pay ran out so applied for incapacity benifit IB

so we went to court and now have to pay £10 a week out of our money i know its not alot but we were only getting IB CTC CB nothing else waiting for IS

then IB decided that he didnt qualify so IB stopped IS hadnt even started

appealed re IB (hubby cant kneel hes had a knee op) so now getting IS reduced rate CTC and CB

luckerly i start work in 10 days(excelent job as a 999 call taker been wanting to do this for ages) and I will be the earner and hubby will be house husband and look after our kids

so will be able to pay more off arrears

i realy dont mine paying for the child but cant it be done at a reasonalbe rate

we get to see him once in a while

what will happen when I start work we will possible get WTC CTC and def CB
I'm often on call :Aso if I suddenly dont reply then i might be out saving a life :j or i might just be having a ciggy:D :rotfl:

  • im sorry you find your self in this situation but apparantly they will take part of your wtc and part of your ctc (but dont quote me).

    if hubby is a house hubby they will take £5 a week as far as in led to believe from his benefit, im sure someone will come along and answer better soon

    I read on another thread somewhere that as you are the main earner, the WTC is yours and they won't take it into account. However, they will take the CTC into account.

  • HI, My husband and myself have had lots of dealings with csa, if the wtc & ctc is paid to you as the working parent they can not touch it.
  • thats what i'd read too but ages ago when i called CSA they told me they cant touch CTC as they are not 'ours' but our kids like CB
    i will have to call CSA again

    Taken from the Tax Credit website, hope this helps as CSA do take tax credits into account in an assessment.

    sorry to sound thick but has the PWC done the DNA test as your paying maintanence, has it been proved that he is your OH?
