Triton - Advice Reqd

Hi
I need some urgent advise. I currently have aloanwith Natwest which has been placed under dispute due to loads of errors which were on the banks part. I received a telephone call from Triton yesterday evening. This was the first I had heard that they were now dealing with my account. I was advised that they are willing to negotiate a F & F with me. If I can come up with £14K in the next 14 days they will right the debt off. I explained that the account was under dispute and that as a Single Parent on a low income where was I meant to get the money for the settlement, to which I was told borrow it. So much for helping me. The woman kept saying if you dont come to a suitable arrangement with us we will start legal action, and when I said go on then, she back tracked. I am a lose as to what to do. I was thinking of making a complaint to OFT and TRading Standards as I am trying to be responsible and sort out my finances, yet Natwest appear to want to push me further down in debt. I would appreciate any advise on the next course of action I should take. Help me please.

OK the first thing which would be useful to see if we can offer any advice is what errors do you feel have been made by the bank
Secondly if they are preapred to accept 14k as a F + F what was the initial loan amount and monthly payments supposed to be.0 -

The initial loan was for £24,000, stupidaly took out when I had had my daughter and the CSA where messing me about. They had also added an overdraft and I suspect some charges onto this. Have requested that they give me a statement, am still waiting. When I asked the woman from Triton for it last night she said that they couldnt send me any statements, so how am i meant to know what I am paying for.
The errors the bank made was first they cancelled the loan direct debit, they didnt even realise until I called them and told them that the money hadnt been taken. They then said they would take two payments the following month, when I asked if they could split it as it would cause me problems they said no. They then decided to extend me overdraft to cover this payment, even though I was not happy with this I didnt feel like I had any choice. They tried to do this twice and both times each weekend didnt process it properly and left me with no money each weekend. When I complained about it was told that basically it was an admin error and there was nothing they could do. I started a new job and called them to see if they could move the payment date by one day, was told that it was OK. But then they took the payment out on the old date which sent me compeltely overdrawn and then when I called them they just told me that the payment date shouldnt have been moved. I have had numerous phonecalls from them ranging from them being nice to telling me that if they had there way people like me would be taken to court and not allowed bank accounts. It has caused me nothing but hassle. I appraoched the bank thinking that they would be able to help me sort this problem out but it has really back fired in my face. I lost my home cause I could afford the rent because natwest sent me completely overdrawn, I had to resign from my management position as I couldnt handle anymore stress which they caused and now feel like curling up and telling them to take me to court as I dont know how much more I can take.0 -
OK the first thing I would reccomend is you stop speaking to them on the phone. If they call you politely and firmly tell them to put what ever they have to say in a letter. and then politely and firmly end the call.
Then write to them and explain that you are not prepared to talk to them on the phone due to their comments like you mentioned. Best thing you can do would be work out what you can pay include that in the letter and how you worked it out and then start paying it even if it's only £10 per month. They probably wont take you to court if you do.0 -

I just cant understand how they get away with such bad practises but have reported it to OFT so hopefully they will investigate and slap them down.
To be honest I am getting to the point where I dont care if they take me to court as at least it would be the end of it.0 -

Triton are not an independent DCA, they are part of Natwest collections. I think they use the Triton name to panic you. If you have written and explained your complaint to Natwest (and even if you haven't already do it now - sent by recorded delivery) then I am fairly sure this means that the account is in dispute and therefore they cannot sell on the debt.
I only noticed that Triton was part of Natwest when I read the very small print at the bottom of one of their letters.

Well things just stranger. Sent Triton a letter about Harrasment and included details about OFT guidelines regarding debt collections. Actually had fax number so faxed and then call to confirm they had received it. Spoke to rather pleasant lady who when I explained why the letter had been sent said there was no record. I gave her the womans name as I had asked for it last night. She was very nice and when I said that I had reported them to OFT for their conduct, she replied "Oh about time". How bizarre. I also spoke to CRU in Borehamwood who was rather rude. SHe said she had no control of how any other department operated but if I would like to make another complaint I could do so. I just gave up at that point and asked for a resolution date for my complaint. I am going to send SAR tomorrow as I believe better fore armed etc. I just find the whole thing slightly amusing now. I will be speaking to Trading Standards as well and once I get the final response if its not satisfactory I will be sending to FOS.;)0
