Second time of posting

Hi All, I posted this on 16th March. Can any one offer any practical advice after READING it, please?

Sorry to sound like I'm throwing a strop, but I thought that posting on here would help. I've still not heard back from Allied International yet, but REALLY NEED TO KNOW what to do for the best, and what to expect, and soon, before I lose any advantage I might have in this situation!

Hi All, I'm new to this and appreciate that I could probably have eventually answered all my own questions by trawling through the zillions of posts on here but find myself somewhat time-poor.....

The situation as it stands...

My wife and I have been separated for almost a year now. At the point of separation there was a joint overdraft and consolidation loan outstanding. She insisted that I pay nothing into the bank as that would 'mess up her benefit claim'

She has since refused to discuss the outstanding amounts, and Natwest first started freezing my personal current account 'to get my attention' then they sent it to Triton Credit services without notifying me. Got a letter from Triton, phoned them, they told me that their systems were down and someone would call me back, no callback later, I chased them and they said it had been sent to someone else. In the meantime, Natwest have closed all the accounts both in joint names and my personal account (which was in credit) and the file has now gone to Allied International......

I called Allied International, and after advising them that I was recording the call was put through to a relatively polite if somewhat impatient individual who professes to be an "Individual Case Manager"

Firstly, he says that AIC have been 'appointed' by Natwest, ( they have not bought the loan ), and that Natwest have only given them instructions to chase ME when as far as I am aware both the overdraft and loan are debts for which we are jointly liable.

He is currently checking back with Natwest regarding this, and reckons that if it is a joint debt that if we each pay 25% of the outstanding balance as a lump sum, the debt will be written off. I have given him permission to text me on a spare number to let me know when to call him, as I have advised I will not take a call that I cannot record.

OK so far, they're not scaring or intimidating me. He reckons that a CCA request should be sent to Natwest and not them. The debt is just under £7K.

Any advice, effective delaying tactics or useful information gratefully received. The current (joint) loan which is in default is a loan which my wife was sold to pay off the previous loan and overdraft. ( She ran the joint finances) I know I'm rambling a bit - sorry! I've had to educate myself in a hurry and feel a little out of my depth at the moment, but am fairly confident I can eventually achieve a sensible outcome if someone would only do their ~@*^% job right.

If I need to be sending special letters or whatever I need to be doing it quickly, I guess. Please HEEEEEEEEEEEELLLP!!!!!

    When was the consolidation loan taken out?

    If its recent then the cca route wouldn't work, but if its a few years old, it may be worth requesting this.

    Just to add also, your post today made a little more sense than your earlier version on 16th march, which is perhaps why you didn't get the information you were looking for the first time round.

    However, whilst there is alot of info on here, I still think you need to have a read through other threads on here also to get an idea of what to do.

    No real help from me, but if you do make a part settlement, make sure it is taken as a Full and Final not just a partial.

    You are aware that, if your wife defaults on the joint loans, you will become wholly liable? For quite a lot of shoes and more than a handbag or two by now probably. LOL.

    Your situation is quite complex and probably the reason you didn't get replies the first time round. Due to this, I would get on to CAB. There's a link in my sig. Be prepared that they may recommend that you engage a solicitor.

    There is not much you can do with regards the overdraft apart from possibly reclaiming any charges you have had, and as suggested a CCA request for the loan. If it was taken out before 6th April 2007, it needs to have all the prescribed terms on the agreement for it to be enforcable, but after this date will be at the court's discretion.

    As they are joint accounts, you are both liable for the debt but this does not mean that the bank or DCA will pursue both of you for payment. Either of you will be liable for the full amount in their eyes.

    It is usually best to deal with DCA's in writing although you should never let them have a copy of your signature. MAke sure you get any settlement agreed in writing before sending payments and that as Whatatwit says, that it is agreed as a full and final settlement so that you are no longer liable for any of the debt.
