HFO Services Harrassment

Hi guys,

I had a loan from Welcome Finance about 6 years ago and never repayed it all. They sold the debt to HFO services and i was paying it back in installments up untill about 12 months ago and now they have wacked on a load of charges and are harrassing me, my parents (whose house i was living in at the time of the loan) and also my ex work which is run by a friend of mine.

I have explained to HFO that i need to see our history and told them implicitly that they should not call anyone else other than me on this matter but they continue to do so. All they have sent me is a letter saying i owe money (£1300) and have been really patient up untill this point but its getting beyond a joke now.

Can any one offer advice as to my legal position please? I am currently out of work and cannot commit to any repayments just now, but this constant harrassment of other people after i have asked them to delete the telephone numbers is particularly out of order and not on.

All i want is for them to send me a letter with full details of our history and i can assess the sitation from there (to be honest i might be slightly more co-operative with them if they werent clearly complete and utter w@nkers!).

Please help, it would be greatly appreciated!

    I would go straight to CAB with this. It is plain abuse.

    ...Unless your parents or friend are guarantors. Please confirm.

    You have 3 priorities that need to be dealt with in order.

    1. Stop them phoning anyone but you.
    2. Stop them phoning you.
    3. Deal with the debt.

    No. 1, then 2.
    Do nothing to further antagonise them right now. They will only take it out on the others.
    Tell the others to stop taking their calls. If they don't mind, ask them to log the calls. If they do pick the phone up, their response should be "This call is being recorded. Joe does not live/work here anymore. You are required to remove this telephone number and address from your system. If I have any further calls from you I will complain to the Office of Fair Trading. Do you understand?" Hang up.
    You then need to write to them insisting that they remove all contact details except your current address and insist they communicate strictly in writing.

    Did you send them the telephone harassment letter, if so, it clearly states in that letter should they fail to cease harassment you will take action.

    If they’ve ignored your request, do what it states in the letter, report them.

    Dear Sirs,

    Harassment by telephone

    I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.

    I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)

    I now require all further correspondence from your company to be made in writing only. Please note that the address for correspondence is that stated above and you are required to remove any and all other contact details from your system forthwith.

    I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

    If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

    Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.

    Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

    Thanks for this post chaps, got them on my case over my father and feel they may be a little troublesome to deal with based on their tone!
