A Question on your partners debts

i'm wondering exactly how i stand re my partner's debt, my partners past keep creeping up on her and to my surprise, We're suppose to be getting married in july which we have managed to save up for :j , but i new letter has arrived chasing payment of an old debt of my partners she knew nothing about and im concerned where i stand in all off this, and when im married does that make me liable to??????

    Hi Bluekaw

    After marriage you would not become legally liable for your wife's unsecured debt in her own name. If you intended to buy a house together you should take advice before taking on a joint mortgage in case her debts ever became such an issue she went bankrupt.

    If its an old debt she knows nothing about then a) make certain it is her debt and not just some dodgy DCA randomly checking people with the same name (this does happen) and b) check whether the debt could be statute barred.

    If she doesn't know whats its for do not acknowledge the debt is hers and do not make any payment (which may count as acknowledgment). If she has to write to whoever is chasing the debt start every letter with the "I do not acknowledge any debt to your company" phrase. If its a DCA the usual advice is not to speak to them over the phone.

    Sorry Tattycath (great name BTW) I think you did a typo.

    You should NOT sign any letters to a creditor/DCA - just print your name. There have been reports that they will fabricate documents using a scanned signature from another one.

    Thre is probably a way through this. Her best bet is to get her to sign up here so we can help her through it. Assuming that she isn't jusy going to pay it off for convenience. I wouldn't...
