dead husbands tax

my husband died in jan aged 51 after working all his life.since he wont be here to claim his pension is there anyway i can claim back some of the tax and national insurance that he has paid over the years.any help that anyone can give would be great.

    firstly, sorry for your loss,
    secondly, when my step dad died I filled out all the forms for my mother, there was a form where at the bottom it was a tick box which said "Do you want to receive your husbands contributions" so I ticked it yes.
    this then enabled my mother to get his pension on top of hers, a godsend really.
    the form was from the benefits office.
    but if your husband dies in january you should have already had this form from them.
    so I don't know where you'll stand now.

    thinking back my step dad died on the saturday morning and I rang the benefits office on the monday, and got the form in the post that week, I then did all the paper for my mother within those 2 weeks, and on one of the forms from the benefits department, was the tick here box, so look at any paper work you may still have to give back, and see if there are any with tick boxes at the bottom of the page.

    Assuming your husband was paying tax up to the time of his death, there will probably be a small refund of tax due for the current year as he will not have used all his tax free allowances. HMRC should send you a form R27 which tells you how to claim. If yu havn't received one, check with his employer that they have sent his P45 to the tax office.

    You won't get any NI rebate. However when you reach state pension age you will be able to claim on your husban'd contributions if you don't have enough contributions of your own. You will also be able to inherit some of his SERPS/S2P.

    You may be entitled to a bereavement pension for 12 months, although you are probably getting this already.
