HBOS and 1st Credit

I'm a new poster here and I have tried to search for a thread to join with regard to my problem but I can't find one that closely matches it or answers my question. If there is a problem, I have no issue with this thread being merged into another.

My issue is this:

I had an unsecured loan with Halifax where, because of unemployment, I have had to reduce the payments. This seemed to be fine until the planned merger with Lloyd's when my account was handed to 1st Credit.

They informed me of this by letter and within a few days I received a telephone call from a very surly person from 1st credit demanding full repayment immediately. His attitude and demeanour was such that I terminated the call and immediately came here to find advice regarding this organisation.

I found the form letters and wrote to them asking that all communication be written. I also did the CCA thing and duly supplied my £1 postal order.

At first they told me that the CCA was with their client. Fair enough. At least the fact that they couldn't supply the document was buying me some time. They then sent me an extract with a covering letter asking if the signature attached was mine. I wrote back saying that it was. The next letter I got from them purported to be from "LCS Solicitors" (with, by an amazing coincidence, the exact same address as 1st Credit.

I duly replied, pointing out that I was fully aware of the bogus nature of their "Solicitors" and further stating that I was aware of my rights and of the fact that they were in danger of contravening any number of regulations by sending this kind of letter.

They replied with a copy of their complaints procedure.

The latest letter (dated 23rd of March - the original request was sent on 5th of January) comes complete with a copy of the CCA. This much is fine, I guess. However, the statement of the account is limited to a couple of lines in said letter stating a total sum paid by me and a 'total sum which is to become payable under the agreement'. Now, to my mind, this does not constitute a full statement of account as due to me by my rights.

So, my questions are these:

Which form does the statement of account have to take?

Does the statement have to be transactional, i.e. does it have to contain an entry of every charge, payment etc.?

Is the provision of an arbitary amount due a statement of account?

    They have complied with the request under section 77 of the consumer credit act. You now need to SARN them and request all infromation and correspondence.
    By doing this they will have to provide you with the transaction history (full statements)
    Was this a straight loan or did you include ppi?
    You will have a very strong argument if you have PPI included on the loan agreement.
