PLEASE help re incorrect info on credit file

Hi guys, i am back again for some help, please!
In 2003 i had a rough time same old story, lost job, relationship went down the pan, depression etc- anyway i will put my violin away!
Since then i have tried to get my credit file back to good standing.
I have a default from 2003. I honestly dont know if it is to do with me as as i say it was a bad time etc , i know i should do a cca, but need help initially with the info below.

experian have been no help they said they contacted the co and they said the upto date info is correct, but they contacted the 1st entry company not the 2nd!! i have mailed them back to tell them this but dont hold much hope

This is a copy and paste of my credit file from sept 2003

Name: MISS xxxxx xxxxx xxxxx
Address: 16, xxxxxx xxxxxxx xxxxxxx xxx xxx
Date of birth: 13/03/1977
Company name: LONDON SCOTTISH BANK
Account type: Mail order
Default Balance : £775
Current Balance : £775
Defaulted On : 10/09/2003
File Updated for the Period to: 30/05/2004

Now this is the same 'debt' but today

Name: MISS xxxxxx xxxxxxx xxxxxx
Address: 12, xxxxx xxxxx xxxxxx xxx xxx
Company name: ROBINSON WAY
Account type:
Mail order
Default Balance: £775
Current Balance: £775
Defaulted On: 05/03/2005
File Updated for the Period to:
15/02/2009

Now, i can see that
1. the debt has been taken on by a new agency
2. they have put a newer address on there
3. the default date has changed

oh and my dob is incorrect

i contacted experian who said they have contacted the company involoved and they say the data is correct - even tho my reports are saved in experian who can read this!!

I have looked at my equifax report and teh data hasnt been changed.
Now, thsi default was due to drop off in October and my file would be clean!! Obviously now they say the default was 2005 and will stand. I dont wanna start contacting these ppl as i really cant be bothered with all the harrassing phone calls and letters i will get from them once i give them an address. As i say i really dont know if this is my debt due to circumstances...please help me, what do i have to do. can i get the date changed back to the original date and how do i do this??

They are not entitled to change the default date. That is really bad.

Follow the advice from page 19 of:

    http://www.ico.gov.uk/upload/documents/library/data_protection/practical_application/credit_explained_leaflet_2005.pdf

If needed put through a complaint with the Information Commissioner.

Thanks, i did contact the CRA and this was what i got back

Further to our recent correspondence, I have been contacted by London Scottish Bank PLC (C14). They have confirmed that the details we hold are accurate and have requested that we retain the information on our database. They have stated that the disputed default date was given to them by their client. Unfortunately I am unable to amend this information without the authorisation of the company in question.
Now as i understand it london scottish the old creditor are infact robinson way the new creditor - they are the same company so i cant see how the data got mixed up!
I will look at the link you posted, thanks so much
  • Could i email them the letter? if so does anyone know a relevant email address?
my printer is broken! also, if i wanted a credit agreement request can i put this in the same letter? Thanks

Which is why it is normally best to dispute with the creditor rather than the CRA. Or even best. do both.

The CRA Wwill just ask the creditor/DCA if the info is correct and take their word for it?

Dispute it direct with Robinson Way and you will build up evidence if you need to take it to the ICO.

Don't know an email address. :(

This happened to me and I was mighty !!!!ed off

I had a deafault with Creation Finance (store card like Topshop or something) and the default date was in 2002 (so was all prepared for it to be wiped in 2008) and then the debt (which I had paid btw in 2002, but I had no proof apart from a copy of statements from mothers bank account that she had wrote the cheque, I sent them copies but they still denied I had paid it, I was that fed up at the time, that I paid them again £150) suddenly made another default pop up under the name Lowell Portfolio, thankfully the default date was 24/12/2002 so that actually got wiped as well last christmas

They shouldnt be allowed to do this!
