Hi all,
If a client won`t pay for a repair to an item (electronic) after 9 months and has not collected it or paid for the repair, am I within my rights to sell it to someone else?
I have repeatedly contacted the customer and they keep saying they will pay and collect and never arrive. I am have been in possession of their goods for over 9 months and they have not been in contact for over 4 months. Can I sell their goods to someone else?

What kind of item was it? what was the repair? repair cost.
Also what are your standard terms, were these shown to the user and was any formal paperwork (an invoice issued) ?0 -

It is a computer, I am a computer consultant. I understand about data protection and so no data will be passed on to any buyer.
Yes, the client was provided with all T&C`s, much work was carried out. Paperwork was issued, but he never replies.0 -
Write to them by special delivery stating they have 28 days to collect the PC and make payment.
Should they not do this you will start small claims action for the repair cost, additionally charging a small storage charge on top until it is collected
I bet its picked up and paid quickly then0 -

The problem is that he has split from his wife and I do not know either of their new addresses. He used to answer his mobile and then say he was going to come and collect, but never did. Now he doesn`t answer his mobile either; even with number withheld.
To be honest I am not interested in pursuing him, I don`t think he has any money and think it would be a waste of my time. However, I have his computer and would like to sell it to recoup costs. Obviously I would wipe all of his data before selling it.
I tend to think that I do have to wait a year before selling it to someone else, but I would like clarification on this point.
