Family member called Capital One - they say they cannot find the account but it is on their credit rating. Is there a way to get this removed if they say they have no record of the debt?

I would be interested to see if an erroneous entry on your credit history amounts to a tort of libel. I suspect it might.BSC No 248

Problem is family member thinks they did have a Capital One card. There is another odd entry on the credit file though - Grattan, which they have never had. Grattan say there is no record either. A notice of correction has been sent to Experian but it seems so unfair that they can do that.
This whole experience has been such an eye opener. Woudn't want to do this for a job though.0 -

LOL. Of course not - there's no money in it!SolicitorMidlands wrote: »Problem is family member thinks they did have a Capital One card. The companies claiming to have no knowledge of the entries on the credit file might elevate the case to people who actually know what they are doing and can sort it out if threatened with legal action. Libel seems the obvious one since it will get you there quicker.BSC No 248

Ahhhhh yes - I will write and threaten that!!

I specialise in personal injury and occupational disease, for my sins. I also seem to be doing a bit of contract law at the moment on the side for general interest.0 -

Oh, btw, re the CRA, you need to raise a dispute with them 1st giving them the chance to correct any errors  if they refuse to remove the data, only then can you proceed with litigation.Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.
