Council Tax Bailiff Advice Needed ASAP

    This has just got interesting. I think these bailiffs have been very naughty indeed.

    It's been a long time since I had to know all this stuff but my recollection agrees with RAS's post - The bailiff can only take stuff on the levy.

    I've PM'ed Herbie and I'm still trying to get through on the telephone. I might have got this wrong but I think the last time I spoke to Herbie on the telephone she said that the bailiffs also couldn't take any vehicle with signs on it (they just told my brother to remove them) or anything that was used for work related purposes and whilst my brother was not using the van for work at the time they took it, it was a vehicle he had been and hoped to use in the future for work. He was only claiming job seekers allowance as he had not had any work for months.

    I have got the telephone number and email addy of the bailiffs. If I did inform them they were breaking the law would it make any difference to what has happened or what they do in the future?? I'm a little bit worried about making things any worse for my brother, all of this is really getting him down, tbh I think he is showing signs of anxiety and depression, although I would like nothing better than to ring them and tell them what they are doing is not only wrong but is breaking the law, wouldn't mind giving them a piece of my mind whilst I'm at it either, lol.

    I understand that this is his fault and he has to pay his bill but I really don't see how intimidating people who do not know their rights and doubling the original bill is helping him to clear the debt off.

    (assuming you aren't medically trained for example and cannot just diagnose like this because that is not always what is presenting; not being harsh but if you think he is being affected in this way there is really only one way to go now to be sensible for example).Well, then, there is only one remedy for this as you've brought it up now. He needs to see a medical person ie a GP!

    Doesn't matter who is to blame/fault it's how he is treated that counts. Whether in debt or not.

    Why don't you step back from this for the moment, wait for Herbie21 to respond or post something on this thread in reply? I say this because there really is no point getting wound up like this until someone replies.
    Any help, opinions, views I may hold those are my own. Respect them as you would expect the same in return. Offered freely, is gleaned from a lifetime of experiences, knowledge gaining. Passed on to benefit others. I may be direct, ask you questions but those are to help you. Up to you if you choose to take it. I won't judge you either way.

    I've tried ringing again and I got through :j (she is one busy lady, the phone has been engaged every time I have rang, lol).
    Thank you all for your advice, feel like a bit of weight has been lifted off my shoulders, its really nice to have people there who let you unload and try and help so thankies again.

    I am so glad. Do keep us posted when she has had time to sort this.

    I may post a link her to a post fermi put up last week, asking for peopl'e experience of bailiffs.

  • I hid my van from the baliffs and changed the log book over, I then checked with dvla that it has been changed over and they said yes, Thought i leave the van with sign writing where it was, Rundle and Co Baliff Clamped it at 6am in the morning. Told him to remove the clamp or I will and also asked him how he knew the van belonged to me. Told him the van is no longer mine and to remove the clamp, He knew he was being out of order, When i finally got throught to DVLA and proved to him that the van is not in my name, His smug smile soon went. He then told be he will break into my house and i said be my guess, as we all know he can't. The debt now has gone back to the council. If you know that the baliffs are coming change you car/van name over asap.

    Hi Everyone,
    Just to keep you all updated. The van auction was on Wednesday, not heard from the bailiffs as yet but will guess they'll be back next week. Managed to get in touch with Herbie, just waiting for her to email us a letter to post onto them. Just wondered if anyone could answer a couple of questions that my brother has:
    As the bailiffs have already been into his house, does he have to let them in again??
    How could he get the debt passed back to the council?
    If he can't get the debt passed back to the council do the bailiffs have to accept some an agreement to make regular payments?
    We're still really confused as to where my brother stands or what he can do so any advice is appreciated.

    God they are ruthless !!!!!!!s arent they. Im all for people just doing their jobs, but if they are devious sumbags like this then !!!! them.

    Again it just goes to show that council tax and rent/mortgage payments should be at the very top of the 'to pay' list. I couldnt be bothered with the aggro, Id rather eat beans on toast everyday than rack up those type of debts. at least if hes unemployed now he wont have to pay the new bill.
    Total Debt -was £14,700 aprox NOW £13,835
    Paying each month-800-850 (hopefully)
    Hope to be debt free about aug 2010
