What to do next? a little help...

evening all!
first time poster, great site!

so i recieved a letter beginning of feb from a debt co. called srj enterprises( they have been mentioned before on this forum)., informing me that i owed them 2 debts of around £4000 and £593.
i rang them to ask where these had come from, they gave me details of an old address i lived at it stemed from there in march 07, well i had been living in my current house since nov 06. it was apprently a nat west account, now i had one when i was student but that was 13 years ago and to my knowledge all taken care of!

so after using letters i found on this forum, i wrote to them asking for the signed credit agreements, enclosed the postal order etc...and the 12 working days has past.
do i leave it as they have stopped or what follow up letter can i send to confirm they have not got said documents? my experian credit report states no debt to natwest.

any advice would be greatly appreciated!!

  • Couls someone of taken out the debts in your name? was the address a shared one?
  • CCA requests do not generally cover bank accounts.

    Someone else here will have to advise on that as ... you've CCAd them, which you will not get anything back because they were bank accounts(?) so none will exist. However, it looks very much like these aren't your debts. :confused:

    Then., using your own post as a reference, why are you requesting documents about a debt that is from an address you weren't even living at in March 07? It's not up to you BTW to prove you don't owe this SRJ lot that you don't owe it but they have to get their facts right before sending you or anyone mail.

    Lastly, as you said you had accounts over 10 years ago, statute barred may apply but ... now you've gone and asked for a non-existent CCA of them which rather complicates things IF the debts are yours.

    Please reply so others here can help you further. :)

  • it was my mates house, i lived there for 3/4 years. i know he wouldnt have done it as hes a mate of 20 years plus and is job is very well paid...:D

    You sent the wrong letter.

    Send them the following letter, the onus is on THEM to prove you owe the debt

    Dear Sir/Madam

    Account no:

    You have contacted me regarding the account with the above reference number, which you claim is owed by myself/ourselves.
    I would point out that I have no knowledge of any such debt being owed to (insert company name).

    I am are familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

    I would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

    Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

    I would ask that no further contact be made concerning the above account unless you can provide evidence as to my liability for the debt in question.

    I await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

    i followed advice on here about asking for cca.
    how does this complicates things?

    Oh, well you got your answer then. It's from an address you lived at, but a debt is registered there for March 07 ... your friend of 20 years who is very well paid wouldn't have done it ... because he's very well paid. Welllll. Looks like either they've got the wrong person, then, or someone stole your ID. Can only make suggestions. Anyway, follow whatever 10past6 advises you do.
