Stopping CSA

Hi, just need a quick bit of advice please (i am the NRP, ex is PWC)
I am really lucky in that i have quite a good relationshop with my ex and we both agree our priority is our son.
I have been paying money to the CSA since sept 08 @ £20 per month. The reason they contacted me is that my ex went on JS.
Anyway, my ex is now working, so ive asked him to contact the CSA and get the case closed, then ill set up a standing order ot pay the same amount straight to my sons account.
While we were discussing this, he said that he hadnt received a penny off the CSA for our son and didnt realise that i was actually paying it!
He mentioned that he had an outstanding debt from a case to do with his other ex (long story, he likes his women!)
Do you think that the money im paying, is going straight to pay off those arrears of his??
Also can he get the case closed and me pay straight into my sons account?

the 2 cases are completely seperate so the money you are paying should be going directly to your ex. He can call and close the case at anytime, but until you receive a letter saying the case is closed do not stop payments, once you have the letter keep it very safe, you never know if you will need it!!
it would be better if you paid into your exs account with payment marked as 'maintainence payments for *childs name*'
then if he wants to put it in your sons account he can. the reason for this is you could fall out and he may imply the money was pocket money for your child?0 -
Thanks Tamsin1982. I wonder why he hasnt received any money then??? they take it straight from my MA so i know im definately paying it, hmmmm odd. Will ring them tuesday and ask and also to check he has closed the case ;0)

Agreed...this is how you should do it to avoid any confusion that may occur in the future
Document all payments properly!
By that I mean you should make sure that there cannot be any misunderstanding what the payments are actually for in the future.
You should do more than just cross a cheque.....you should also
send a letter with each payment that you make, to the effect that the payment is specifically made to support your child (ren).
edit...You should also name the child (ren) that the payment is for.
edit...The letter has to state that the money is for child maintenance and it must also stipulate for what period
Postal orders will suffice provided that you keep the stub, DO NOT LOSE THEM!
Ensure that it has the correct name in the payee section. Ensure that you cross the order or make sure that it is crossed when you buy it. If you dont cross it then it can be cashed and is much more difficult to trace in the future. Dont forget to send a letter with the postal order as I have specified above.....and again...very important indeed...
DO NOT make cash payments!
If you make payments through a bank, then I would advise that each time a payment is taken from your account, then you also send the letter as detailed above, to the PWC.
Keep copies of these letters, DO NOT LOSE THEM!
Make sure that each letter is dated with the same date that is on the cheque.

The letter thing i can do and keep copies both on the computer and also in a file (luckily i am very very organised when it comes to paperwork and have paperwork from 9 years ago, when i first moved out from home!)
Just one more thing, do i pay 4 weekly in arrears or advance? at the minute they take it straight from my MA so ive no idea if its in arrears or advance.0 -
CSA payments are usually paid in arrears.Donedoingdebt Lightbulb moment January 2000. Debt at highest approx £102,000. Debt now (October 2009 - absolutely fork all!!!):beer:
