Returning HP Car to Ford - Anyone already done it?

I'm returning my Mondeo to Ford under s90 of the CCA (voluntary early return) it was second hand and I've had it nearly 3 years (re financed July 2007)

The questions I have are these;

1. Are you responsible for any mechanical fault when they divvy up the money they want off you to fix it before auction, I know you are responsible for cosmetic stuff like paintwork scratches and ripped interiors?

I ask because when I purchased it I had 3 months warranty, the rear calliper went and I was told this was 'wear and tear' and not covered - I fixed the calliper but the opposit side has now gone and I suspect I will be looking at £300 - 450 for it to be replaced by a Ford mechanic

The Air Con needs regassing - £60 - 100

The rear washer jet doesn't work - £???

And I think one of the front brake discs may be slightly out of line (or it may be the effects of the calliper)

I plan to go bankrupt on the 7th May 2009, should I just return the car, get the bill and add it to my debts (along with the outstanding finance)

Lastly - the letter they sent me said the car had to be in a roadworthy condition - taxed and tested - it will have test and tax - when I purchased it there was only a couple of weeks tax on it - I have just put 12 months on in Feb - I want the disc back so I can cash it in - has anyone else done this?

  • Hi there when I returned my car some time ago, I couldnt find my Service receipt so I had to pay for a service for them, even though the book was stamped. I had to pay to have my bumper repaired also. Cant say if mechanical faults have to be paid for but I would imagine so.

    With regards to the tax disc, I left mine in but I dont think it had long left on it.

    Although I have little experience with HP I can see no reason why you can't bankrupt the bill so you might as well do it that way IMHO. If your going to go through the hassle of a bankruptcy you might as well include anything you can.

    Regarding the tax if it has to have tax on it when you return it I'm not sure theres anything you can do. I don't think you can for example cash in the 12 months disc and put a 6 months etc. You might have to take the hit on that.

    Sorry - I know nothing about BR or car finance! I do however know that you can "cash in" your tax disc at the Post Office and they will refund you the remaining months left on it. If you need to leave some cover on it though you may only get a few months back - but something is better than nothing eh.

    I just returned my Audi, I took the tax disc and have sent it back to claim my 6 months - they pay you back for every full remaining month. They will most likely simply auction the car anyway so if you don't take the tax, you won't get it back.

    As for mechanical faults I would imagine so, ask on the transport forum, someone there will know but I would think you do need to get it fixed, that said I'd suggest getting it repaired at a decent local independent as they would be cheaper than Ford.

    I'm due for my bankruptcy hearing in about 5 weeks, I'll let them fix it and just add their bill and outstanding finance to my BR ... Ha ha, snooker them dastardly torags

    But, shhhhhhhhh, don't tell them yet!
