Mate clears off owing 15 grand

Four years ago a friend of mine left to go live in SE Asia leaving debts to various financial institutions totaling around 15k.
He seems to think that when or if he ever returns to the UK, after a period 5 years,his creditors if they can locate him will not be legally able to hound him for their money and debts would be written off.
I'm not so sure about this and "could" possibly be classed as "obtaining money by deception"which is an indictable criminal offense.
I'm going out to see him next week and would like to advise him of any possible consequences if he should return.

    I don't know about deception, but absconding to avoid paying debts is probably illegal.

    You should look up statute barred debt on the net.

    Yeh right, while the rest of us mugs arent as devious and have to pay.
    Sorry, but people like your friend really get my back up, honestly, its people like him that have contributed towartds to putting the banking system in the bother its in. presumably hes earning money out there so what is the problem with making arrangements to pay even some of it back? 15K isnt a massive amount of money, certainly not enough to make me want to run off.

    Anyway, seems drastic, I thought SB was 6 year. Tell him not to come back til 2020 just to be sure.
    Total Debt -was £14,700 aprox NOW £13,835
    Paying each month-800-850 (hopefully)
    Hope to be debt free about aug 2010

    the Statute of Limitations does not apply where the debtors has deliberately avoided debt.

    So he might have to do some explaining as to where he has been and why he made no attempt to keep up the payments.

    If they obtain a CCJ in his absence, the debt won't become time barred either.

    This is what I said to him that 15k wasn't enough to warrant doing a bunk for.
    I explained to him that I didn't agree what he was doing BUT if he was going to do it,he may as well go down for 50k as opposed to 15.

  • You mentioned you are going to see him? After he's absconded to another country, committed what one would construe as 'fraud?' Excuse me, but wouldn't you be involving yourself by association with this deception?

    Oh, many. Especially if the police were to become involved.

    As for this:

    That would ultimately boil down to whether he borrowed, without ever intending to pay it back I would imagine and then 'did a bunk' to another country.

    Oooh, apart from the billionaire bankers who defrauded the system. Maybe the first 1 billion wasn't enough to live on. And plunged major countries into poverty. Oops!

    So, yes, this 'friend' (always get suspiscious of posts with 'friends' for example) did that but in perspective ... no, don't agree with it but ... perspective. Never mind. Have to wash my mouth out now after realizing what I did. :D
