DMP and Creditors

What happens if a creditor refuses to accept a DMP through pay plan are you then stuck or does it just take time for them to accept it....what if the never accept it :eek:

    it took a little while for a couple of mine to accept but to be honest it's in their best interests to accept as at least they will be getting some of what you owe. same goes for stopping interest not all do to begin with. I've found DCAs much easier to deal with and once the debt is sold to them they all stopped interest. payplan and CCCS are used to dealing with the ones who say no to your dmp and will probably say carry on regardless astey eventually all come round

    I've wondered this as well.

    It does take a while for some to accept. 2 of mine still haven't 2 months in and the lady i spoke to yesterday said not to worry, that wasn't unusual. A lot take at least 3 months.

    But if they never accept i'm not sure. i think you just carry on paying regardless and Payplan keep on asking them!

    Have you thought about getting the CCA's (original signed document of the credit, i think that's right anyway).

    Someone else can probably explain better as i haven't been through the process yet but if you have some refusing to accept it could help!

    I had problem with Halifax accepting my DMP for my overdraft. It seems they will only accept them after the account is over the overdraft limit. Before then they completly ignored any attempt at comunicating with them about the DMP for that account. I just carried on paying what I could. Eventualy the debt was passed to their DCA and everything went smoothly. They pretty much accepted the DMP immediatly and accepted the payments I was offering.

    Most creditors seem to take a couple of months to accept the DMP especialy if you've been making the payments up untill then.. I think they think if they are awkward people will give up and go back to struggeling to pay.

    If you're having problems with one creditor stick with it eventualy they will accept. After all whats their alternative. They can take you to court but you'll be able to show that you've been reasonable and done all the right things so the judge is likley to be unsympathetic to them.

  • I have been on the CCCS website and complete a debt remedy which suggested a DMP. I have decided to write letters to my creditors offering a pro-rata payment first.
    What do I do in the meantime until they reply? Should I just pay what I can afford (the amount I have offered)?
    What happens if they say no? Can I then ask CCCS to contact them on my behalf?
    I am trying to follow the correct procedure and really dont want to end up with letters from a court over this so any advice would be greatly apprecaited.

    I have been with the CCCS for 3 years this December and Lloyds credit card still havent and have never stopped the interest, and only about 4 months ago did Lloyds over draft stop charges :( Not much I could do apart from send letters, plus only pay when the CCCS split between them all.

    If you have set up with the CCCS and letters have been sent out, are you now paying the CCCS? If you are or are due to pay the CCCS within the next month then just get the letters sent via you or CCCS and then just pay the monthly lump sum and nothing to the creditors.

    If you are paying yourself, then just pay the amount you have told them you will.

    If they say no and you are going Via the CCCS then get the CCCS to keep sending your Expenditure sheet and a letter to hopefully freeze charges and interest.
    I had 11 creditors and at first only 4 of them instantly accepted, then about 3 months later I had 8 accept, and for about 2 years Natwest kept charging, then stopped.

    Honestly just stick at it, I never got threatened just charged lol

    I have jsut sent the letters myself this morning and will pay what I can afford this month. I thought it may be best to try this way first. If I don't get anywhere with them I will contact the CCCS and arrange to pay through them.
