SAR request received now confused!!

i have sent off two sar requests one to halifax and one to lloyds. friend advised one cheque cashed and thought it must be halifax as they have passed me on to a debt collection agency. and today i received a letter from HBOS plc enclosing three leaflets, one being "credit scoring" another "our privacy statement" and the third "personal customers complaints". however what worried and confused me in their letter was a paragraph which said;
"Please note, HBOS plc is not obliged to supply records held in paper format if they do not form part of a relevant filing system"
is this there way of getting out of providing written proof of my signature? plus further down letter they ask me to contact them in order to ensure they match my exact requirements? is this a ploy to get me to call for another blast of bullying or am i supposed to re-iterarate what i am requesting. all is a bit confusing? can anyone who has received the same help me understand this please???
also unrelated but still have not received a yes/no from lloyds about my offer of a f and f and its been 3 weeks now, should i ring them and ask?
plus thanks for all who suggested call barring and choose to refuse peace at last has been restored, well temporarily anyway

Does the account number on the HBOS letter tally with any of you own ACCOUNTS?
Without seeing the letter you sent it is hard to comment but the DPA originally only covered electronic records and was extended to paper records about 5 years ago.
i suggest you contact the Information Commisioner and if your letter was correct, then send a formal complaint to the Compliance Officer. You may have met a minion who does not understand the DPA?If you've have not made a mistake, you've made nothing0 -
The " relevant filing system" text is pretty standard. There were a few cases where banks had stated that microfiche records were not classed as a relevant filing system but were forced to go through the records and see if there was data or not - this was brought to light mainly from people requesting data to reclaim charges.
I would phone them and just state what oyu had put in the SAR letter - they may be trying to get confirmation that you are who you say you are. Did you sign the letter? If not then this may just be them double checking.
You want a note of all transactions (not copies of statements, but will accept this)

Yes they are.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

well that was quick and easy, she said as the request is usually done by phone she just wanted to confirm what i wanted. i said i did not have the letter to hand but reeled off what was written above and she filled in the spaces and just said that she may not be able to supply copies all telephone calls that had taken place as not all were recorded but would do what she could and hopefully within the 24 hours
ps. i have just called lloyds, well i say lloyds but it is a call centre in india and they have said they they too are declining my f and f because it is not 85% of what is outstanding. she has also been informed by lloyds concern department (very strange name) that i have sent in a request regarding charges, i dont hink she knew exactly what i had requested. but what she did know was that they would hassle me no more until they were told outcome from these concerns. she advised me to continue with my minimum payments and to let me know charges were building up. (just what i wanted to hear)
do i now follow both halifax and lloyds now with the template for 1st refusal of f and f or wait for the outcome of these sar requests??0 -
The SAR will let you see if they have the original credit agreement and if it has all the required terms (and your signature).
